I have retained Mr. Nicol and his firm to represent me during my simple divorce (no kids, no Property, no ugly stuff) I knew it would be a simple divorce as I had a contested divorce almost 10 years ago. I retained Mr. Nicol because I knew him personally and wanted to give him my business although he referred himelf as an estate lawyer.
During summer of 2015 I met him to discuss the case in his office.He asked me to pay $6,800.00 for an uncontested divorce in Duval County. When I expressed my shock about the fee and said to him that a friend of mine in a similar situation paid only $ 1,000 he quickly changed it to 3000.00. I was quite surprised when he dropped his fee almost to half even though it was still very high. ( during these discussions he mentioned many times that these fees were for a "friend")
I agreed to it since I knew him and expected to have him finish it easly and painlessly as he promised. I paid 3000 plus all filing fees and did not hear from him for months. When I called his office in November 2015 and asked him the status of the case, he calmly said that my ex did not pick up and/or sign for divorce documents. I asked him to serve her in her place of work, he said he would. Another 2 months passed nothing happened.
Finally I asked his office what was going on, they arranged a meeting for me in Mr. Nicol's office in Jan 2016. I was quite surprised when Mr. Nicol said that another lawyer would takeover my case (again I hired him beacuse I knew him and I knew chosing an attorney is a personal decision) Of course, both "attoneys" (one I found out not to be an attorney later) started to let me know that this case was getting ugly and she was going to ask for the world. In short I was in trouble!
I continued to inquire what has changed, they replied that my ex now decided to contest and this was going to cost me. When I tried to explain that it is not what she is telling me and I had nothing to give, they firmly convinced me that I did not know the system and it could be very costly but they will charge more. I signed another fee based retainer for $2500.00 ( BTW, uncontested is 3000.00 but long and difficult contested divorced was only 2500.00, maybe he was finnaly realizing I was a good client :)) 2 months passed and I was asked to bring another $1,800.00 so a lawyer can come to mediation with me ( I only paid $ 200 for mediation). This was the last straw, I asked to go and mediate by myself since I did not have any more money nor lender left. They immediately pushed a paper for me to sign that I would relieve them from representing me. I was furious and upset how can I be out of almost $6,000.00 and be at square one. I then asked them a list of charges so far (of course almost 12 months later I still did not have any invoices for the monies I paid) The list they finally gave me was a template printout from some lawyer website and all bogus. So in short please think twice and/or really investigate all lawyers in this firm before you hire them. I do not want anyone to be burned like I was.
