I won an auction, with Worthridge Auction company, in May 2016. I had to call to see when the merchandice would ship, and just like the other person who copmplained, i too was told that they forgot, they were soooo busy. OK fine, I finally received the merchandice, but one of the items that I won and PAID for, did not have the LOA. I emailed and got a response that they should be getting them soon and will mail them out as soon as they get them. They were very appologetic and I didn't think nothing of it. In August, I emailed them 3x and no response, so at the end of August I called and spoke with a man, who had an English accent. He went on and on about how unprofessional this has been handled and would get the LOA, within 2 weeks. Fast forward to 10/19/16, still no LOA, so I called, got the same man and the same response. He said he was going to call the boss and call me back. Needless to say, I haven't gotten the promised phone call. Now every time I call it goes into voicemail.
My question, and I hope someone can help me, is this, isn't this a breach of contract and fraud. Could the victims (and there has to be more than the O/P and myself) sue them.
I am from PA and I am not familiar with NC rules.
