Met with Bill Crowley with WISEGUYS CONSTRUCTION, LLC about an ad he had listed on Zillow under the name Platinum Properties, LLC. Advertising to build you a new three bedrooms two bath home for $10,000 down.
“New construction underway come pick out your finishes. This attractive cottage style plan features 1300 ft.² of fine living space with a split plan, large open spaces, kitchen island, fireplace, oversized kitchen, huge master bath and closets, optional screened porch, and garage which allows for rear or side entry. The exterior is just elegant with its many historical details and wonderful charm. Property qualifies for the revitalization program, so the new owner will get a 95%, 10yr. property tax rebate.”
During our meeting, Bill mentioned multiple other locations he was in the process of purchasing that were all part of the revitalization program we could choose from to build on. After going over what we wanted in the house we selected a lot. We were told that
1- Bill would need a letter from our banker stating that once the home was completed we would be able to Secure financing for our bank for the home.
2- Bill would need a $10,000 check to go into an earnest account that would be used to help pay the closing costs at the end.
Our banker contacted Bill and emailed the requested documentation and I wrote the $10,000 earnest check that was supposed to be put into a separate account for closing costs at the end. We were then told Bill would start looking at and working on different plans he had so we could come back in after a week and look at plans and decide what house we wanted to build. Before that appointment, I had voiced to Bill I was concerned about financing such a large amount. When I met with Bill he reassured me we could still get the house we wanted on the lot we had chosen without maxing out our loan amount of $400,000. he asked me to go ahead and sign a contract and said he would email me plans that day for me to choose from and that he would start building the house the next week. I never received those plans despite the many times I text and called requesting them.
After over 6 weeks of trying to chase him down, he proposed a much much smaller home in a much less desirable location. When I told him I wasn't happy with either of those locations and I wanted to stick with the original plan. He responded stating he is no longer willing to build the house as agreed upon and that he would only build it if I went and obtained a loan from the bank of his choosing. Accusing me of being too wishy-washy with my financing. My financing has at no point changed or been wish-washy I personally just wanted to build a little smaller home and not utilize the entire amount I had been approved for.
From day one I have stressed the importance of getting the house done promptly I have two teenagers who are going to be seniors next year and we have to have them rolled in school to start their senior year continuing to wait it’s just not an option.
I also explained to him that if he had decided he would not build the home as agreed upon he was breaking the contract. His response was to call me an idiot and tell me my $10,000 earnest money that was to be used for closing cost was nonrefundable although he had decided to refuse to build our home. Even after a long conversation with my banker Paul Hughes his response was he was no longer able to obtain the financing to build the home. If he can't I understand but he has left us in a bad situation and should at least refund the earnest money that was to be set aside for closing costs.
