Mr. Steven Gautier Winther is accused of obtaining a FRAUDULENT judgement from the New York County housing Court by intentionally and maliciously lying to that court in his court filings and concealing facts to obtain a default judgment against a tenant who had resided in one of his properties. Mr. Winther had his attorney serve the tenant at an apartment in his buliding when he knew the tenant had NOT lived in the apartment for years.
Mr Winther then had his attorney file a FRAUDULENT "Affidavit of Service" within the Housing Court swearing under oath that the tenant was served with the Petition. Mr. Winther then had his attorney go to court and obtain a $24,000 default judgement against the tenant who was unaware of the pending legal action because he was never served with the Petition. Mr. Winther then had his attorney file another legal action in the Supreme court for costs against the tenant and told the Supreme Court Judge he had won a $24,000 Judgement against the tenant to give an air that his claims were legitimate.
After the tenant uncovered the fraud, he filed a Motion to Dismiss in the Supreme court and an Order to Show Cause in the Housing Court. The Supreme Court judge DISMISSED the lawsuit against the tenant and the Housing Court Judge vacated the $24,000 judgement. The housing court Judge scolded Mr. Winther's attorney when she asked him "HOW DID YOU GET THIS JUDGEMENT?" "YOU ARE AN OFFICER OF THE COURT. DID YOU NOT THINK YOU SHOULD HAVE INFORMED THE COURT THAT THEY WERE NOT SERVED WITH THE PETITION?"
Prior to appearing at the housing court hearing, Mr. Winther was asked to voluntarily vacate the $24,000 judgement because the tenant was NOT served with the Petition. Mr Winther's REFUSED to vacate the Judgement and forced the tenant to fly into NYC from another State and caused him additional money damages.
A Federal lawsuit was then filed against Mr. Winther for FRAUD in filing a FRAUDULENT affidavit of service within the Housing court and then using that fraudulent affidavit to obtain a $24,000 money Judgement against the tenant and causing him to lose money in defending against the fraud. In addition, $250,000 in punitive damages has been requested against Mr. Winther.
