Drop off Friday, 7/24/20 at 10:15 am and still had to unload it. Unloaded by 10:23am.Miles went over the controls and left. I then took pictures all around the dozer to show the condition and damage I received the machine in, that was already there. Gas tank was full when it arrived. I drove the tractor to start work.It worked pretty well for the first 4-5 hours and then started shutting off. Saturday, I tried to use it again in the afternoon (his office was closed), and it continued shutting off.
I went and picked up 2 cans of starting fluid, and had to keep using that to restart the engine to keep it running. I used the dozer a few hours on Sunday and then waited to call Miles on Monday morning. I did not have his cell phone number at that time. I called Miles Monday morning, and told him I thought it was an electrical problem because the voltage regulator light came on and it seem to coincide with the engine dying. He said he would be out to look at it. He came out and worked on the tractor and looked through it all and he thought it was was an electrical problem as well. He took the alternator off and said he would be back and was going to take it to go get it tested.
He also said he would give me a few extra days to make up for the down time. He also mentioned to me that the previous renter had put old fuel in it. He never returned that day. He returned Tuesday and worked on it, while I was out.
He found that it was water and rust in the fuel filters that was plugging it and blamed me for putting it in his machine. (I received this machine full of fuel and the problem started before I put any fuel in it) I did put fuel in it before he worked on it, but it was brand new diesel from a certified dealer.
The conversation we had after he fixed it, he blamed me for this happening, and was yelling, was belligerent, and aggressive and loud on the phone and hung up on me. He also said during that conversation not to worry about the solid yellow warning light for the charging system. He said it is working just fine. He would not let me talk, and then he said “that’s it, you’re done, I’m coming to get the tractor.” I then used the tractor that day and called him back in the afternoon. I apologized for arguing with him, and then explained to him that I had a big job to do and I needed a working tractor to do it, and that it would be stupid of me to put bad fuel in a machine that I needed to work. I know very well that these machines need to have clean fuel to run correctly.
He said, “I have proof, I have it all in jars at the shop.” I am not sure how he could have any fuel at the shop because he changed the filters out here on the property, and there was a lot of spillage around the machine. He continued to blame me for the bad fuel. The conversation ended with me keeping the machine, but that I had not put any bad fuel in it. He didn’t I continued to use the tractor with no issues with my fueling or fuel for the remainder of my rental period. (4 weeks) On August 6th, mid morning, a hydraulic hose broke on the front right side ram and I brought it down to the area where he worked on it the first time, and called Miles. He said he would come out right away to see what hose needed to be replaced.
He arrived and started to take apart the machine to get the hose disconnected. He stated he would run to the office to make a couple of hoses, he said, because he might as well replace both hoses since he is replacing one. Where the hose connects to the ram, it is under a steel channel that protects the hoses. I have pictures and video of this before he fixed that hose. He returned that evening and fixed the hose. I used the machine without any further issues and completed the project. I did call him twice the last week I had the tractor to try to find out how many extra days I was going to get, so I knew how to plan the end of the project.
He never returned my calls, so I stopped in his office to ask him, He stated that he got the messages about the extra days, but he was sorry that he didn’t return my phone calls, as he didn’t have time. He then said it was my problem that the tractor was down due to the dirty fuel, and I was not getting any extra days from him. I asked for clarification on what day he was picking up the tractor and he said it would be 8-21–20 at noon. I called the office the morning on the 21st and told Chuck the tractor was out ready for pick up at 8:51am. I had it fueled, and cleaned, and I blew out the air filter and the radiator. I also took pictures of the hours used and the entire tractor condition. Chuck called me back at 9:24am and asked me if the tractor was outside the gate for pick up, which it was. I asked him what time Miles would be picking up the tractor, and he said he wasn’t sure, but it would be sometime that afternoon.
Miles showed up at 3:21pm and he got on the tractor and I showed him the hour meter and opened the fuel tank to show him it was full. He turned on the key and stated “the gauge said it’s full, so it’s full.” I put the cap back on the fuel tank and he loaded the tractor up, never talking to me at all during that process of 20-25 minutes. I did ask him when the security deposit would be credited back on my card, and he said it was electronic, and he would not get to it that day, but it would be done the first thing the next morning because he was very busy and would be out on runs picking up other equipment. I drove by the shop on my way into town later that day, and saw that he was there, so I stopped by to ask again about the security deposit being credited back.
Chuck came out and said he had to go through the machine, and that it would take time and he would not get to it today either. He was angry and irritated and quite frankly nasty to me for asking a question. He said he would get to it on Saturday because he has a process he has to go through. I said I would be back on Saturday morning. I wanted a receipt for the credit. I returned on Saturday 8-22-20 at about 10:00am and Chuck was there and said he had not worked on the security deposit return yet, but he would get to it by 12:00 noon that day when they close. I confirmed asking that he was returning the whole deposit, and he said no, I had two service calls and 2 hoses I had to pay for. He blamed me for tearing/ripping the hoses off, I told him that was not true and this isn't right. He said just because I said it is true, doesn’t mean it is going to happen.
He became angry and walked away. I then called Miles and he said I crushed two hoses and kept talking over me, without letting me talk and then hung up. Valley Equipment Rental is accusing me of misusing their equipment and charging me inappropriately, holding back my security deposit. Icontacted the BBB and they sent my Complaint to him which he never responded. I filed a complaint with the state DOJ attorney general.
