Luis had given me a purchase order for the amount of $35,500 for molding services for my invention on July 12th 2017. The estimated time was 4 weeks to be completed with molds and samples. I additionally purchased 5,000 units, and colors needed for the product, making a total of $43,100 paid in full. All of this is documented through email, receipts, phone conversations, and text messages. Luis first told me they were running behind on the molds, making it an additional few weeks as new molds need to be tinkered with. I gave him the benefit of the doubt because it seems legitimate as the molds need to be tested and calibrated if needed. As the end of August approaches I feel as though he should be able to pull this through all together. Still no sample, he keeps telling me samples should be done next week. Week after week he keeps saying the same thing.

You will receive samples next week" and "We will sample tomorrow and send you them for next day air" were the most common phrases he would say through email and phone.

Moving into mid September, he decided to tell me that he should have been more honest with me and that his mold maker had gotten into a motorcycle accident back in August, and that the lead times were now heavily delayed. Are you kidding me? He really could not be honest with me, a customer who fronted $43,100 paid in full and now decides to tell me? He still has not even delivered a sample. Going back and forth with his excuses that he is still testing them, I am getting aggrevated. He had then sent me a random sample on October 13th, 2017 for another product that "got mixed up with another customer". Does he think this is a joke? Who the heck mixes up two shipments for customers that are on completely different sides of the United States? I finally received my first sample on October 27th, 2017. This sample was pitiful. The quality of the sample was digusting. The pieces tore apart easily, colors were not on par with the exact color we had chose together, and the density of one of the components was not near where I had stated. Of all of the time he had to make this pefect just like he said he would, it was absolutely appauling.

The following week we had a phone conference. He kept giving excuses about how he underestimated the lead times, he should have been more honest, and more nonsense that he kept saying. He finally gave a hard deadline of November 29th to deliver a final, perfect sample. He said if I did not receive the sample, I could go straight to the bank with it. Sure let us believe him once again. Go figure, he fails yet again to deliver on the 29th, and at this point I knew he did not give a care in the world about completing my project with his so-called expertise in the industry, care to me as a customer, and for myself as a business owner, I would not let a customer feel this much disrespected, let alone still waiting on fulfillment of services to be rendered.

I kept going back and forth with him on emails, calls, and texts. He kept saying that he wants to make this a lasting relationship for business to business. What a joke. Christmas had just passed and I received a one component to my product. I was even more outraged. For those who are unaware, when plastic is ejected out of a blow mold or any mold, it has plastic that needs to be trimmed to get exactly to where it needs to be. My component was not trimmed, and I was furious. He could not even take the time to trim it for me. I called him immediately and asked why was it not trimmed, he said I wanted you to have one of the components to see the quality. Unreal excuses after another. I knew at this point it was time to request a refund in the full amount I paid for.

On January 15, 2018 I called him and requested a refund. I also sent him a letter signed by myself stating everything that is to be returned to me, including the money paid in full, and any materials and prototypes I sent him for reference as well. He said he would take care of it all by Friday January 19th, 2017. I go into my accounts on that same Friday and go figure no refund. I knew this would happen seeing that he has always dodged me on Friday calls or mishaps. His two awful samples that he created for me always arrived on a Friday because he knew it was his day to check out and not be in the office, let alone hear me absolutely furious with the lack of professionalism and desire to fulfill my needs as a cusomter. Today January 23rd, 2018, he emails me stating he will send me a refund proposal. Is this guy really serious right now? I am not accepting anything less than the full amount I paid for this business owner to continue this abusive practice of lying, being deceptive, lack of professionalism, and desire to fulfill his duty and pull through and give me exactly what was paid for in full. The time is up for him. He needs to refund me immediately and return everything that I sent him.
