We placed an order for a $1,949.68 sandblasting unit (product) from TP Tools & Eqipment (seller) through Amazon.com (broker).
Shortly after we receieved an e-mail advsing that we need to call someone in order to process the order:
"thank you for your purchase just received and want to process your order without delay; but we
do need to talk to you to get additional information such as daytime contactable phone numbers for
the motor freight carrier, confirm that you have means of unloading this 430-lb cabinet from the
tailgate 4' off the ground of an 18-wheeler or if you need to purchase the $50 lift-gate service, hours
for delivery, if a "Call Prior" is required, and if there is a business sign, etc. Therefore, please call
Becki at 1-800-321-9260 between 8:30am-4pm ET at your earliest convenience so that we can get
your order going (once order is entered, motor freight shipments are usually picked up the next
business afternoon."
We did comply and call the number, and were told that only phone call conversations would be official and that only our director and a particular person at TP Tools & Equipment must speak in order for them to process the order.
The problem was that our person and their person were only available at certain times of the day we were not, and questioned why that and only phone conversations were nessicary to make it or be official.
We did, at our expense, have our director and foreman/contractor communicate with the seller as requested.
We had paid for the order $1,949.68 plus an additional $1,450.00 for phone coordinations with our director and contractor IN FULL to the seller.
A week had pass and we inquired to the status of the order and were told it had not been shipped yet. We were told that it would be shipped right away according to Amazon.com (broker).
We did get an e-mail from the seller confirming shipment eventually, however this after the date:
"As stated in last email, Becki did contact and confirm everything with
Robert James on 2/17/20 per your 2/14/20 received as we were closing for the
weekend. The order was picked up by Estes yesterday 2/20/20 and
was at the break point in St. Louis, MO at
1:39pm, with an estimated delivery date of 2/27/20."
We did make phone calls to confirm and did explain that because of the week delay in shipping and other delays, this was past out due date for our project and we are already at a loss.
However we did request that they continue to ship our order.
We did receive this e-mail from the seller
"On February 19, 2020 the buyer requested a order cancellation request
through Amazon. On February 21st, the customer spoke to us and wanted to
continue with order verbally. Since we had the cancel on file, we told the
customer we needed written authorization through Amazon stating the customer
still wanted the order. Until March 3, 2020, we have never heard from the
customer even after we sent 3 additional emails to confirm. At this point we
decided to cancel the order and stop the shipment. The shipment is due back
to us today or Monday.
Unfortunately, it cost us $ 402.35 to
return. Once the order is back to us,
less freight out and freight back. We
freight rate with our carrier to save
ship the order out and the same to
we are willing to refund the buyer
are trying to negotiate a better
the customer on the freight charges."
At no point did we ever request cancellation and we even had both phone and e-mail conversations dated afterwards to CONTINUE shipment and CONTINUE the order.
The seller never requested that we e-mail anything and we had already agreed that all official communications would be through phone calls only.
The seller still wanted to keep the shipping charges, and we are still out or money in allocating people to communicate with the company for a product we never receieved.
