My name is Aaron. I am the co-founder of Trigger Point Systems, a California-based business. We design and manufacture fitness/massage products. The reason I am reaching out to you today is because I want to make sure that no other companies will fall victim to the fraudulent activities and bad faith demonstrated by the company named “Touch of Modern”.

We started doing business with an E-Commerce company named "Touch of Modern". Touch of Modern sells products in "online events", where they offer different products for limited periods of time (typically 5-7 days). The payment term that we agreed upon was net 60. After the first event, they messaged us saying that because our event was so successful on their platform, they would like to do another event with our products.

Although they had not paid us yet for the first event, we agreed to do another event with them, which was also a success (in regards to selling numerous units). They then did the same, and we agreed to do a 3rd event with them. All 3 events were within the 1st net 60 time period so they were not obligated to pay us for any of the units sold at the time.

Fast forward to June 22nd, 4 days before the payment of the 1st event was due to us (for the units sold during the 1st event). We then receive an email from their "head of sales/sourcing/buying" saying the following:

-ToMo is alive and well. Though ToMo has been restructured, we are very much open for business and will be paying suppliers and vendors in full for goods and services after the acquisition date.

- ToMo will pay suppliers and vendors in full for goods and services after May 27, 2022. Due to the nature of the acquisition and the ABC process, ToMo is not responsible for any of Touch of Modern’s liabilities such as debts and outstanding vendor payments preceding the acquisition.

From my understanding, company restructuring is not something that happens overnight, it usually takes months (at least 60 days) to hash out all the details. We feel like our company was onboarded during this time period, despite Touch of Modern being essentially bankrupt.

To us this email pretty much says that they knew that they were going bankrupt but still accepted brands/companies like ours, despite knowing that they had no intention of paying us for the inventory that we sent out for their customers. They accepted payment from the customers but they are turning around to tell us that they don't have money to pay us back. I find this to be extremely unprofessional, fraudulent, and bad faith.

Touch of modern sent me a pair of shoe's that were to small

they do not have a phone number only messaging, so I sent many messages trying to make sure they sent the right shoe size. they couldn't find my order but they could sent the wrong size.

try to get my money back ON RETURNS only a credit tryed to use the credit can't just a scam

Touch of modern is a internet online company out of San Francisco , that I built up credit and then they stated my credit expired. This is a scam .

Do not order any product from this company! I ordered 3 large ticket items and none are bing sent! I called one supplier for a $450 mirror, and they said they do not have any orders from Touch of Modern have been placed! The website has specific info that Nezza is the supplier!

I ordered some stuff from this place, my first and last time. I received my order, packed in environmentally unfriendly 'peanut' packing material. My items came unpackaged, like they were picked up from street venders in little China, not "Italian" like shown in the pictures. The actual size was smaller than shown in the picture. Basically the merchandise is all knock off crap. I should have known better from the deep discounts, but the website is very nice. I was scammed, my fault, avoid this place you will be scammed also.

I purchased a very expensive set of PORTO stemware as a gift from T.o.M.. I bought it in early February for an anniversary March 21. It finally arrived in the second week of April.

The items were described as stemware perfect for *sipping* port wine, being 7 inches tall. The items which arrived were almost twice that size, capable of holding about a half a bottle.

Port is expensive and vinted to be enjoyed in small snifters an ounce or two at a time.

These are utterly useless for that purpose.

Customer "service" took a week to respond to my email in which the suggested I read the original listing once again, they didn't specify but I assume because it stated the sale was final. Had the items i received been the items described on the original listing I would understand, but they didn't so I'm not sure how the sale is final, except that T.o.M has decided that unilaterally.

And o yes, when they respond there will be 2 lines in the beginning of the email asking you you to rate there service: "Yes, Im satisfied" and "No, I'm unsatisfied". Clicking "unsatisfied" immediately closes your ticket and I assume satisfies the corporate beancounters if not the customer.

Purchased Keysmart (key chain) from Touch of Modern. After waiting two weeks, I noticed no activity on the USPS tracking number provided. Michael, customer service rep, told me to wait a few more days to see what happens. A few days later, I get an email from him stating since he hadn't heard from me, he was putting my issue to 'resolved' status. I was told to wait, then he pulls this stunt on me. Any further communication with them has been unsuccessful. No replies to any further email at all. >
