Joe Noonan is the manager of TMC Management. I signed a 1 year lease. Lease ended 8/31/2015 and part of my contract was to provide a 60 days notice if i planned to move. Things were ok living here. I planned on renting another year since i had not heard from the company of a rent increase. Aug 30th I paid my rent, Septmeber 3rd I received a phone call stating my lease expired and I needed to do another year lease. I said ok no problem. Then his wife Jocelyn Noonan stated the the rent increased on September 1st. I told her you do realize it is September 3rd and that if I must give a 60 days notice then you must provide me with the same courtesy. I told her i did not agree to the rent increase. Two weeks later Jessica calls to tell me Erika you know you are in a month to month lease I stated yeah ok.
Initially I was never aware that I was in an automatic month to month lease until I did some research to find out that I was no longer in a year lease, but in a month to month lease although that is not what i thought when I paid September's rent and when I had not given my notice to move 60 days prior to September. I thought I was going into a year lease. Once Jessica told me this I told her then I am moving because I do not agree to a rent increase with no prior notice.
I did not believe I should be responsible for a month to month fee of $75 because that was not my plan nor was it TMC's plan. I started having neighborly conversations with my neighbors to see if any of them were experiencing similiar problems and a few were, others just turned blew it off and agreed to the increase not wanting to fight the money hungry Joe Noonan.
Joe was upset that i had spoke with other tenants. Two tenants told me that he waved their rent increases for a month/two months. Joe threatened to evict me if I did not pay the increase, month to month fee and late fees. I gave him my notice to move in 60 cleaned that place from top to bottom better than they had cleaned it. I even took 80 pictures and had a tenant walk through and to see how clean I had got the place I was tired but I was proud of my work and the fact that I didnt just leave the place a mess for what I had been through with Joe Noonan/TMC.
I received a security disposition stating charges of $1800 plus. One example $82 stating damage to blinds that were so cheap and flimsy I did not allow my daughter to tocuh them, $75 for dirty kitchen, range and fridge, $50 dirty bathroom and toilet, $239 carpet cleaning per lease etc. I have over 80 pictures to dispute these lies. I took pictures of every wall and every floor and window and space in that apartment. Still they charged me $1800 plus. I want to fight this company in court. I want this company to pay for it's lies, pay for the stress it has caused I want this company to be investigated and past tenants be contacted. This outstanding balance of frivolous charges will go on my credit if I do not take them to court. I intend to fight, but I am so concerned about others that have been negatively affected by this company. There should be some kind of penalty for landlords that abuse their authority as landlords.
I too went through the same thing that had a deposit of mine of $1000 ans still tried to charge me and additional $1000+ for damages as well same as you I took pictures but they never proceeded with taking me to court or anything
