BEWARE! Elliott Stone is this new brand of crooked attorney that hides behind the Internet promising he will cancel your debts, get you money via the Fair Debt Collection Practices Act statutes, blah, blah, blah. If you have a valid debt, too bad, he can't cancel it. The best he can do is maybe get you a whopping $1,000 IF the creditor actually violated FDCPA! That's your booby prize. Here's how his business model works:
1. You call claiming you have an abusive creditor or simply someone you don't want to pay what you owe (c'mon, you know who you are?).
2. He agrees to take your case on a contingecy basis giving you false hopes that not only will your debt be cancelled but, alas, you may make some money as well! Wow! What's not to like about this guy?
3. He then files a "boilerplate" lawsuit (complete with mistakes) against the creditor with all kinds of outlandish demands (pain and suffering, emotional distress, etc.).
4. He then battles back and forth with purjerious documents, ill-gotten default judgments, and other annoyances to run up his attorney's fees with the hope that the creditor will settle on something and pay his attorneys fees.
5. He gets an agreement from the creditor to pay some or all of his attorney's fees and you get, at best, a delay in paying what you owe, at worst, a counterlawsuit against you which you now have to pay to defend!
Note that Stone never even went to law school! Check the California Bar website--no credentials are listed for this con artist.
He came close to being disbarred a couple of years ago for deceptive business practices and has been sued for malpractice. It's only a matter of time before this legal pest hiding behind "attorney priveledge" gets his a*s kicked out of the bar!
