I received a voucher to redeem 1-4 nights at a Las Vegas Casino Hotel for a deposit of $33 per night for taxes and fees associated with the reservation. This company set a bunch of exclusions as to when the reservation could take place and how long in advance you could request it and I followed their instructions.
Their agreement reads: The accommodations will be in a hotel/resort such as Stratosphere, Hilton, Excalibur, Bally's, Holiday Inn or comparable as assigned. Please note, all the aforementioned hotels are within a mile of the Las Vegas strip. Therefore, any reasonable person would expect a hotel of like quality within a mile of the strip.
This company booked my reservation over six miles from the strip and refuses to abide by the contract they wrote!!!!!! They are threatening to keep my deposits if I cancel this stay. I am simply asking that the company honors the promise written in their own contract and stop threatening to keep my money that they cashed before even making a reservation. The company responded by circuling a portion of their contract states accomodations are booked by availability and they reserve you within 25 minutes of the vicinity you choose.
The business promised a hotel that is comparable to Hilton, Excalibur, Bally's or the Holiday Inn. (All within a mile of the Las Vegas Strip)
After that promise, the business added a contradicting statement in their unilateral contract reserving the right to book 25 miles from the promised destination.
By law, this contract contradicts itself and is ambiguous. If this was taken to court, the judge would clearly see the business created a contradicting contract in an attempt to defraud clients.
Moreover, the business is implying there are no reservations available during the dates in question in the hotels that were promised. Per the attached, by searching only one of the named hotels in this contract, there is more than enough availability for the business to maintain its agreement.
I want the business to abide by their own contract and reserve one of the named hotels or issue a full refund.
Rec'd several calls. States I have been selected by their group to rec $100 spend a anywhere &$50 restaurant.total $150 Asked which cr card# visa or mc. Would charge $4.95 only when I have recd the gifts. I asked if this was a scam,she said no a marketing company was doing this
