Conflict with Lawyer's Own Interests

Loyalty to a client is impaired not only by the representation of opposing parties in situations within 30 paragraphs (a) and (b)(1) but also in any situation when a lawyer may not be able to consider, recommend or carry out an appropriate course of action for one client because of the lawyer's own interests or responsibilities to others. The conflict in effect forecloses alternatives that would otherwise be available to the client. A potential possible conflict does not itself necessarily preclude the representation.

The critical questions are the likelihood that a conflict exists or will eventuate and, if it does, whether it will materially and adversely affect the lawyer's independent professional judgment in considering alternatives or foreclose courses of action that reasonably should be pursued on behalf of the client. It is for the client to decide whether the client wishes to accommodate the other interest involved.

However, the client's consent to the representation by the lawyer of another whose interests are directly adverse is insufficient unless the lawyer also believes that there will be no materially adverse effect upon the interests of either client.

I have never seen such unprofessional conduct from a pair of lawyers as I have with Michael McGovern and Roberto “R.C.” Rondero de Mosier of the Gober Group. These two shady individuals would routinely go out (2 to 3 nights a week) to strip clubs with one of the partners in our company who was their good "friend" and the only reason we used them as our lawyers. All of this of course was paid for with our company money. But the fun didn't stop there. The three would also partake in drugs like cocaine and ecstasy and have lavish hotel parties with strippers and prostitutes, all paid for with company money.

It's hard to imagine how there wouldn't be any conflicts of interest under these circumstances. What's even worse is the fact that Mr. Mcgovern and our partner are both married with young children at home. That didn't stop them from cheating on their wives together with their new "stripper girlfriends" and prostitutes 2 to 3 nights out of every week. One weeknight, Mr. McGovern was so drunk and messed up on drugs that he dove into the shallow end of the pool at the swanky hotel they were "partying at" and cut his face open in multiple places and had a black eye for a week. Of course our partner had to lie and cover for him to his wife with a series of lies.

This wouldn't be so bad if not for the fact that our partner established a "quid pro quo" relationship with Mr. McGovern and Mr. Roberto “R.C.” Rondero de Mosier. Although they were hired and paid tens of thousands of dollars to be our corporate counsel and represent the best interests of the company and each of it's members equally and in an unbiased way, they did the exact opposite. They unfairly represented only the interests of their "good buddy" and helped him screw over all of his partners for hundreds of thousands of dollars. I can't believe that The Gober Group, with clients like Senator Ted Cruz would allow such shady, unprofessional people to work at their firm.

Unless you want to be lied to and ripped off for hundreds of thousands of dollars, don't hire The Gober Group.
