Contacted SPN in purchase and install of a fiberglass Blue Hawaiian pool in 8/2018. Assessment conducted by SPN owner Boris Blank.
Indicated projects had been done prior by his company in our county, Richmond NY. Have emails to show proof of such. We have pics of his prior project in Richmond County sent by his staff. After several conversations on logistics with operation manager Bonnie, we were urged to “lock” in price despite our request to have install in April 2019. We actually visited their pool yard 8/2018 and even noted that our original pool choice was wrong. Note taken and pool model changed. Contract signed 9/2018.
We have numerous calls and emails from Bonnie even apologizing for the constant outreach. A deposit of 5500 provided to SPN via bank check. In 11/2018, contacted by Bonnie that company structure had changed to Eminence but it did not affect our project. Blank had split from his partner listed under Ladybug Pools.
SPN: Requested a 11/2018 install. We denied request due to our original contract being a 4/2019 install and due to three reasons, it was holiday season, no return survey of property as promised and no blueprints provided on project. They basically wanted to rush the job prior to company structure change. We learn later..Their NJ contractor license was under review.
In 2/2019, SPN confirmed 4/2019 install and pool purchase. Again we inquired about whether a contractor was to survey property as indicated at contract. This led to SPN establishing Google Earth plans as suffice. Concern was expressed since most companies needs plans for piping and electrical. Prior to 4/2019 install, request for additional funds was made. After inquiring again and told a contractor would come prior to install, the funds were sent via bank wire totaling 26000. We were hesitant but told if the funds were not sent... the pool would not be delivered. This would become a contract issue. Therefore the second deposit was to secure pool delivery by Latham Pools aka Blue Hawaiian.
Upon install date, schedule was cancelled. Upon our insistence, a contractor J.D. came to property unprepared and requesting blueprints. He indicated that no information was given to him prior to arrival and there were some install concerns. This proceeded to an additional meeting with Boris Blank and contractor three days later. At this meeting, it was determined project was “difficult”. Plans were made by Blank that included a helicopter lift and a crane lift of pool into our yard.
Blank was unaware of a location to store pool upon transport into Richmond County. These were red flags. After two appointments set with crane operator, operator determined lift of pool behind back property as unsafe and a hazard. SPN owner indicates that we refused access when it was determined by operator as not accessible. Contract was signed for access through side property only. Access was granted from 9/2018 contract signing.
No issues were addressed at contract signing. No written documentation by side neighbor was requested until 5/2019. Addendum was sent by SPN to have neighbor sign for side access as well as any damages being our responsibility including we were unable to speak to any SPN employees while on our property. We found that to be odd. We refused such addendum. Blank during our meeting even indicated that he would “pay” our neighbor for any hardship if they needed the crane. Another red flag. Who was paying for this?!?! These issues were not addressed until AFTER contract signing and AFTER funds were accepted by SPN. As homeowners, we requested the blueprints, licensing, and permits as per county regs. We did not want to be at jeopardy of any fines due to lack of appropriate paperwork. Consequently, three install dates were projected and a plan of a ramp indicated by Blank as a means of installing pool.
The install dates were cancelled by SPN. No receipts for such ramp provided. We requested initially that due to pool delivery and size of our narrow street, the transport be during a off school day. We have a busy Street on school days. With all the install cancellations, we accepted any date to start project. Although, the permits were necessary.
SPN NEVER PROVIDED COPIES OF BLUEPRINTS; LICENSING TO CONTRACT IN RICHMOND COUNTY (NY); or PERMITS. SPN was responsible for pool purchase;delivery; and install of fiberglass pool. In turn SPN owner proceeded to terminate contract indicating our refusal to access property, our request, and verbal harassment.
He could not show any documentation to prove his accusation when we requested. He proceeded to indicate we speak only to his legal counsel. He proceeded to use legal counsel to abide by his termination and refused to return funds for the project. Due to agency involvement, SPN returned in our objection only 25000 of our funds and continue to hold the remainder.
We accepted funds in protest. We have acquired information of this individual utilizing various company names and history of similar business practices under these names. His website is now stock photos. We currently have Dca involved and as of recent, Blank has not responded to their request for total funds to be returned. No work was conducted on our property. He attained a job without licensing in our county to complete.
He falsified his information in his rebuttals without any proof to his statements. He neglects to indicate his lack of licensing to complete the project and his termination was a tactic to avoid indicating such. He is a fraud. I spoke with his pool salesman 6/2019 who could not indicate whether the pool was ever delivered... “ a invoice for an order was placed in February but no record of delivery”. They do not want to assume responsibility since he indicated that he was “harassed”.
He neglects to indicate that he has over 30000 of our funds during 5/2019 period. We are not responsible for his incompetence nor for his dishonest business practices. Consumers beware. His business titles change. He is under different business titles including a “film alliance” (?) and party supply business. The second time he came on our property in his broken down yellow hummer (only 2x’s he met with us), he was condescending and rude. Bbb has been involved and was able to connect his last two businesses since prior to my contract signing he had no complaints. Buyer beware.
Do not give him a deposit. He will take it and use his contract to terminate the project falsely. He contends verbal harassment but tried to bribe us with upgrades. When questioned what upgrade, his operation manager refused to answer. The issue became she could no longer answer for him since he had no paperwork to show. His lawyer has yet to respond to our legal counsel. That says it all!
We have only requested that our entire funds be returned. All information can be proven through a series of emails and texts. Blank contends harassments and difficulty only because we ensured all conversations were written. We have nothing to hide.
Update
A settlement was reached in Civil Count Richmond County in satisfaction of complaint.
