On February 25, 2018 I signed a three-month contract for unlimited infrared heat therapy for a total of 90 sessions. I was charged $131.99 at the time of purchase with two months recurring payments of $89.99. I had to stop the treatment during the first session because it triggered an extreme migraine. I told the clerk at the time and she was very kind an apologetic. She said I would have to come back on a weekday between 9:00 am and 5:00 pm to sign a cancellation form with the manager. I told her I was unable to do so, as I work those hours 30 miles away. She gave me the telephone number of the manager.

When I phoned the manager, Jessie, she was also very kind but said she would have to phone the owner, Chad, to get permission to cancel the contract and refund the payment. Jessie quickly phoned back and said the owner would not cancel the contract or refund the money, but he would give me in-store credit for tanning or teeth whitening. I explained that I don't use tanning beds because they're harmful and I don't need my teeth whitened. Jessie apologized again and gave me the owner's telephone number to discuss further.

I phoned Chad, the owner, and explained the situation. Chad said he wouldn't cancel the contract or refund the money just because I didn't like the service. I explained again it was medical, not a matter of like or dislike. He said if I got a note from my doctor he would not process the third payment. I said does it seem fair to you to charge your customer $221.98 for 30 minutes of electricity? He said small business owners must do this to stay in business. I told Chad, in my professional role (I identified my title and employer), I work with numerous small businesses and the vast majority do the right thing for their customers. I said is $221.98 worth me filing a complaint with the BBB and the Missouri State Attorney General's office of Consumer Protection? Chad said I was using my professional position to harm his business. I explained I am calling as a consumer, not in my professional capacity.

The conversation was going nowhere so I told him I was finished talking and would be filing complaints.

Chad phoned me back and said he would issue a refund of the second month, but it had already been processed. I asked why he would charge me already when it had only been 11 days since I signed the contract? I said he was taking advantage of customers. Then he asked me again, where I worked and said he would be phoning my employer to complain about using my title to intimidate him. I told him he is one of the most unscrupulous business owners I had ever encountered.

I phoned my bank and cancelled my debit card so he cannot scam me out of an additional $179.98. I am filing this complaint and filed one with the Better Business Bureau. It is my sincere hope that this complaint will save other consumers from being scammed like I was.
