My 17-year-old was shot twice by three males in an attempted carjacking on 10 June 2020 (Dekalb County Police Incident Report: Case Number 20-0446 76). On 29 June 2020 @1:08p, I was contacted by the police department stating their investigation was over and I could go pick the car up from South Dekalb Towing & Transport, which also included advisement of all towing fees having been waived since the car was a part of an investigation. Upon reaching the towing facility within the hour, we were told the car had been repossessed and to contact our lender.
We contacted Bridgecrest who indicates they were advised on 13 (initially) and subsequently 23 June 2020 that the car had been abandoned by the towing facility. However, the Criminal Investigation Division stated all along that the car was a part of their investigation and we could not retrieve it until it was complete (i.e. per photographic evidence of a call) Pictures were emailed to us by a detective as we grew weary and wanted to report the resultant accident/damages to USAA (our auto insurer). Since 29 June 2020, I have awaited Bridgecrest's response, today (13 Jul 20), I am told they will waive the towing fees they have paid, as the police's waiver apparently did not apply when they picked the car up, albeit I am responsible for repossession fees or they will sell the car at auction.
I have seven days to contact them at a minimum. However, the directive is being issued by the assistant director of the charge-off department. USAA has yet to assign an adjuster to the case, due to the nature of the accident the initial adjuster was relieved of duty. As a conscientious, well educated, tax paying and voting member of my community, I ask that you provide representation with regard to the issues I have raised herein, as it relates to joint and several liability for these tortious actions as per claims against South Dekalb Police Department, South Dekalb Towing & Transport, LLC and/or Bridgecrest Financial Service.
