After purchasing a Living Social coupon for $99.00 single treatment at SAY NO TO LIPO I was pressured into signing a contract with them.
If I paid right then and there I could get 3 area's done for $3000.00. Tummy, side's (Love Handles) and upper arms. I tried to make a standing arrangment for appointments. Thinking every other week etc, since I was paying for 3 area's to be done we cold rotate areas.
But being unavaliable is how SAY NO TO LIPO avoids you and eventually descourages you from even trying to make an appointment. I would call and get transferred to Dave's voice mail, not hear back for days and then have them cancell the appointment on the day of ! Not only that but sometimes the machine was broken so even though I was there AND THEY WERE THERE ...there was no treatment since the maching wasn't working.
In all I had 6 treatments.
I requested a refund for the areas not done.
I have a record of all my calls and appoinments and would LOVE to take these crimnals to court.
On 8/3/15 I saw on LivingSocial an advertisement of Vaser Shape Treatment for $99 ($700 value). I contacted them and scheduled an appointment on 8/6/15. That day, I signed a contract for 2 areas plus love handles for a total price of $2,700 - paid in cash (10% discount). Additionally, it was given to me "1 extra session without expiration to be used on another area" (due to the fact I mentioned I wanted to buy the treatment advertised in LivingSocial for only $99 (instead the $700)
Summary:
On 8/8/15 - I sent an email to Abbey Denton-Kellum (Executive Vice president of the Company, person who did the consultation, provided the contract/paper to be signed and received the total sum of $2,700) with the following information:
"My first session was scheduled for 8/7/15 at 8:30 am.When I arrived to the session the machine was not working, so the tech re-scheduled me for the following day at 11 am.
On 8/8/15 - A different machine was there but unfortunately it was not working properly. The temperature was most of the time below 40 degree Fahrenheit (34F - 39F) and for short periods no more than 41F. For the explanation provided the day of my consultation, if temperature does not go over 40 F. I am not a good candidate for this treatment. Tech was concern that the machine was not getting the proper temperature either. She unsuccessfully changed the settings probably 10 times while in my sessions trying to get it to work.
Per explanations given the day of the consultation, the settings of the machine regarding my main goal (fat and cellulite reduction basically) need to be very well programmed in the machine. I noticed and asked the therapist the setting and she said that is was a "Combined". What make me think that was not my goal as you described in the consultation (tightening vs. fat/cellulite reduction)
I let tech know that my package included both legs front and back at the beginning of the session. But I noticed that she only focused in an area just below my gluteus and the inner thighs. She never went over the area above the knees in the back or front side (as it was marked really well in my skin with the red marker at the time of the consultation).
I feel that your level of expertise in HOW to apply this technology in patients per their unique necessities should be communicated more precisely to the tech, so everyone is on the same page with the treatment, and how to apply properly the setting in the machine to achieve the client goals as effective as possible."
On 9/2 - I sent another email to Abbey Denton with the following information (repetition of the experience had from the beginning of the treatment to 9/2/15):
"Cancelation of treatment/Reimbursement
Good morning Abbey. Following up on yesterday voice message, due to several incidents occurred since day one in my treatment (that I have timely made you aware of them), I have decided to cancel the treatment effective immediately and be reimbursed the sum paid on 8/6/15 for $2,700.
Summary:
First session was scheduled for 8/7/15. When I arrived the Machine was not working.
Reschedule to initiate on 8/8/15. This time a different machine was not working properly. The Temperature was between 34F - 39F (for short periods no more than 40F)
After I sent you a list of incidents and concerns, you agreed, apologize and I decided to continue with treatment.
FIRST SESSION - 8/13/15 - We agree to initiate my first real session on 8/13/15 at 11 am. That day you were delayed and pushed the appointment 15 min when I was already there and I was ok with that.
SECOND SESSION - 8/25/15 at 9 am. That day you behind for 30 minutes with a new client and again I was ok with that when you asked me while I arrived on time to my appointment. Unfortunately, again the machine was not working properly and it was getting disconnecting almost every 5 to 10 minutes (one time worked 30 minutes straight). It is my understanding that per each client there is a personalized machine setting to attack the problematic areas. My concern is that every time the machine was disconnected that setting was deleted. When manually started, that specific setting was not entered every time the machines stopped working. On the other hand, My contract states that I will receive 60 minutes of treatment for each legs and 30 minutes total in love handle area (Total 150 minutes of treatment). That day I barely received 120 minutes of treatment in some concentrated areas as advised.
Intend of THIRD SESSION - 9/1/15 at 9 am. (email with appointment was meant to be for that day but was sent with wrong month - Tuesday August 4th). As agreed in prior session on (8/25/15), I arrived that day on time to receive treatment in other small areas as advised (different from the ones treated second session). Nobody was there. I sent you a text asking you if you were late. You replied that it was a mistake in my appointment and that was scheduled for next week (I have not received any appointment confirmation via email or text as of today).
Due to all those aforementioned incidents, I want immediately cancel my treatment and be reimbursed the totality of the sum paid - $2,700 -"

After that, I have been following up via phone and text to Abbey who said I will be contacted by "Dave". I asked for his phone number or email address but she did not want it to provide.
On 9/17/15 - Dave (His real name is David Luginski. Found it on sunbiz.org under corporation title "Just say no to lipo, INC) sent me a text asking if I have a question about my contract. At the end, he said that I signed a document acknowledging there is NO REFUND for treatments. The only option provided is to continue with the treatment and they will start with the session the machine was not working properly. I did not accept that deal and I replied to him that I do not recall signing that document and doc is not included in the package provided with copies of all document signed. (Please note that Abbey Denton is advertising at the time of the consultation that if you are not satisfied with the treatment, 100% refund money guarantied). I asked David to provide such a document and he promised to send it, but he never did after following up with him 5 times.
Bottom line, I paid $2,700 in advance for a total of 10 treatments (2 areas plus “love handles”. 60 minutes each legs plus 30 min on “love handles” area). In not one of the first three sessions were they able to provide the services contracted for due to a multitude of reasons to include malfunctioning equipment, inadequately trained personnel, tardiness of staff, and scheduling errors. I therefore seek a refund for the full amount paid.
I want to mentioned the fact that there are several complaints filed again this company (see BBB Case # 67312282 and here in this site).
