Knowing I was illegally towed I asked for the signed Authorization, Access notice and photos which I was denied by the employee at Santa Ana club. Several days later after becoming angry when they still said they couldnt give me the signed authorization I was given a slip that did not have the required information.
It was from a company called "P. Management" Employee name "E. Olmos"- No title, No address for the company, and an unreadable jibberish phone number for the company.
This sent red flags up immediately. I questioned the employee on this and he immediately wrote the phone number from memory onto my form. He didn't even have to look it up.
More red flags going up.
I called the phone number on the form and it was from a business with a virtual address. This individual refused to say who he was subcontracted for- that it would be a violation of their clients privacy.
Woah.. More red flags. A company that is able to authorize tows and not validate who they are!
He would go on to say that they were there to tow from the lot that had cars from low income housing.
Santa Ana Club has created an environment of confusion to extort money from the general public. Their targets- from the mouths of "P. Management"- low income housing areas where the families are forced to park because there is a lack of parking.
This company has immoral unethical standards. They have thrown that out the window. The money is too good. For every one person who gets their money back there are 20 others that believed the company and thought that a business would not just outright scam you.
The guy you talk to when they are in trouble- Calling himself "Gonzalo" the manager. He is very likable and knowledgable in the law- but his main function is to confuse the situation and misdirect.
To prevent predatory towing and ensure the property owner has authorized a tow company to impound a vehicle, the California towing laws and regulations say a written authorization is required before the tow occurs.
The towing authorization must have the following information:
- The time the authorization to tow the vehicle was made.
- When the vehicle was first observed being parked.
- The reason for the tow.
- The name, title, signature, address and telephone number of the person authorizing the tow.
- The license plate, vin, make and model of the vehicle being towed.
If the required authorization is not obtained the towing company is liable for four times the amount of towing and storage fees.
This company clearly is guilty of predatory towing. My daughter parked in an underground lot for less than an hour. The parking sign is so faded that it cannot be read. She was towed. She is a full time Grad student, and I paid the towing. In looking at the reciept, the tow company stated that they towed her from an address that does not match where her vehicle was. In researching this company, they used to do business under Pepe's Towing, which was cited numerous times for its predatory towing. Small claims court for a full time student will be impossible. There needs to be a full investigation into this company.
