On June 1, 2019 David Roxwell through his company Roxwell Construction which has an operating Office at 34 East 1st Street, 2nd Floor, Mount Vernon, NY 10550 was hired by my 19 year old daughter at my recommendation and paid a deposit of $25K to fix and flip a house she had bought on auction.
He recommended he would take $25K and the balance at the balance of the end of repair. Up to mid-August he did not commence the job. I approach him to start the job or refund the child’s money. He commenced. David Roxwell and his team demolished a kitchen, a butlers pantry, a bathroom and a partial wall to the living room from kitchen and an adjoining wall between two bedroom rooms in just three visits.
According to the Scope Of Work “SOW” which we agreed on, the demolition cost was $4K. He took 3 half days to do that with a crew of two day laborers. David Roxwell shared he needed $30K more. I was taken aback because it seemed too early to be wanting more money and he had agreed to wait until the end to be paid the balance.
I went ahead and applied for hard money construction loan and was awaiting its approval but in my view there was enough funds for David Roxwell to continue doing more work. In the meantime I asked David Roxwell to provide evidence of how the $25K was utilized in just three days.
David Roxwell decided he did not need to provide me with that information. In fact he said that until I gave him the $30K he would not resume the job. On my side I was going by the SOW he provided us with and according to that the demolition cost would be $4K.
I had hired the plumber to bring water from City onto the property and have Roxwell Construction pay that plumber $600. I later discovered the dumpster and haul was paid $400. When the loan came through on October 1, I explained to David Roxwell that going forward a progressive payment schedule will be established with the SOW into a Contract to avoid misunderstandings.
David Roxwell said that was fine with him. I had my attorney drafted the contract and sent to David Roxwell and he has not signed it. After two weeks of waiting on him to sign I reached out to him and he said his Assistant was making editions to the Contract and Schedule. I waited another week and still nothing.
October ended and I am now in a aggressive loan program for a house that was bought all cash. However, David Roxwell did not care and made no action towards resolving this stand off. I tried on several occasions to get third party intervention through mutual acquaintances and still no progress.
David Roxwell told them he was dealing with me. I waited until in the second week of November to eventually bring a new contractor to clean up this mess. This new contractor is a thousand times better than Roxwell Construction. He is honest, transparent, detailed and is a God-sent help.
I will recommend him to anyone looking for a good contractor in this sleazy business. I have since asked David Roxwell for a refund and terminated his services (well technically he abandoned the job). Again, David Roxwell agreed to refund but said he would work on a figure.
When that money was not forth coming I asked him to supply the siding material that he claimed he had ordered and was already committed to but they delivered inadequate amount and the wrong color. I told him he needed to provide me with the invoice so I could make the swap or order more of the same erroneously shipped siding.
He has not been cooperative and have stopped taking my calls. David Roxwell held us under duress for two months, with the intent extort extra money. He knows that it is damaging to a client to have an unfinished job, because it gives the impression to other contractors that the client is bad paying. Therefore no contractor would want to take on such jobs.
David Roxwell knew this was money my daughter got from her deceased father’s Insurance we were working to buy this house to fix and flip for a profit during the Summer and the cash accumulation was to be used to pay for my child’s college expense throughout the year.
Instead of completing our job over the Summer, I suspected David Roxwell used the money to fund his many other projects. So September came and we had to take out a student loan. On top of that because of his action I took out a double digit aggressive construction loan putting a business lien on this house. We may lose it if this loan is not repaid in full in 6 months.
David Roxwell appears to be a respectable, professional, well-spoken, well-groomed family man, but the public ought to be made aware that he is a cold-hearted, calculated, cruel liar and thief! His appearance is a part of his con. Don’t be fooled. David Roxwell & Roxwell Construction ARE First Class RIP-OFF ARTIST!
