Randy Hinver, California Highway Patrol badge #015784 marked my correctable registration (VC 4000 (a) (1)) citation as "NO" under section where it should have been marked YES, correctable under CVC 40522. I believe this was not an oversight because from the moment he stopped me he was rude. I pulled over immediately and he stated on his PA system (loud speaker) to pull forward further. WHY? Do you have control issues, I was safely pulled onto the shoulder!!
As soon as he approached the passenger window I handed him my license, registration and insurance. Randy Hivner asked if I paid my registration, I stated "YES". . He asked for the receipt. I handed him the PAID statement from the DMV requiring smog check. He said "this is a bill". I stated "It clearly shows at the bottom a $0 balance due.
He then proceeded to ask why I didnt have my stickers, I replied "smog check" Assuming he was going to give me a warning or a "get it fixed" he comes back to my work van with a ticket to sign. I advised him I would be filing a complaint against his badge number. Had I not been in a hurry I would have refused to sign the citation and demanded to speak to his supervisor right there. I later perused the citation further thinking ok, I will simply have it signed off, expect this dirtbag marked it as NOT CORRECTABLE!!!
Now I had to waste my time to contact the court, ask for a court date to speak to the judge, take time out of my day to drive to court, sit in court with societies degenerates, many of which befoul the air with their body odor and low priced body sprays, wait for my name to be called in alphabetical order, present the vehicle code to the robe and have the citation dismissed with proof of correction. I did the aforementioned, FOUR hours later my citation was dismissed with correction. Randy A Hivner could have provided a warning, could have marked my ticket as correctable per CVC, instead he's the reason most citizens cannot stand police officers. A d*** move! Do you have a quota to meet Randy Hivner?? With your overpaid salary (est $93k annually) paid for courtesy the tax payers you should focus your time on actual crimes, not infractions where a business owner has encountered 5 perfidious mechanic's over several months, weeks tied us in aggregate in repair shops, and spent over $6,000.00 to remedy the check engine light issue which prevented me from getting a timely smog check. The same mentality of Randy Hivner, we have useless government rejects which legislation passed by the state congress requiring smog checks on diesel engines a few years ago, which diesel engines never required and were exempt. With the newer ubiquitous diesel exhaust and particulates filter systems required on all new diesels, my vehicle has close to ZERO emissions and shouldn't be subject to smog checks!! It's just another way to steal money from it's citizens.
Complaint has been filed against his badge. If you too have been pulled over or dealt with his attitude I urge you to file a complaint against his badge number with the CHP.
