On the day 17th of May 2017, we hired Rainaway roofing to re-roof the roof of our property, address - Miami - Florida.

They provided us a permit # for the job. We delegated Rainaway Roofing to buy construction materials and do the job.

From the day of signing the contract, to date (4 months and half) the roofing crew came 4 times to do the job, putting us in a very unsafe position for months.

After the first working day, they left half roof with no cover and half roof still with the old roof.

More than a month after, they showed up the second time, and again half of the roof was done and the other part only partially done.

To finalize we had to wait another month and half.

In between the working days, we have called rainaway owner Brandon Jensen tens of times (cell phone - test messages - emails) with the result of either never answering or answering with show up promises that have never been fulfilled. They were never answering even though our requests of informations were just standard requests on a date to go on with the work

In between that time frame, Rainaway failed 3 out of 4 inspections on our roof and didn’t provided the city of Miami building department with the appropriate documentation for the inspections (as per attached documentation)

During that time frame we paid 85% of the job to Rainaway roofing (11,700$ out of 14500$ )

After the first month, we received a "claim of lien " from Gulfeagle Supply because even though we paid 25% of the job, Rainaway roofing failed to pay the materials we paid them for.

Even though we paid Rainaway roofing in timely manner, The lean notice became an effective lean on our property, in the amount of $3,721.30 ( + $ 325 filing fees)

Rainaway roofing reassured us that this was a "normal procedure", but after another month and several reassurances, we received from the Miami dade Court a law suit from Gulfeagle Supply (the material company) for the material that Rainaway roofing never paid them, even though we paid them 85% of the job.

So in this 4.5 months time frame the results have been

A construction lean on our property

A law suit

Our property is in foreclosure process

We are facing increasing costs

We have tried to work out the situation both with Rainaway roofing (in the person of the owner Brandon Jensen) and with Gulfeagle Supply, but the problem is we owe Rainaway roofing 1750$ and Rainaway roofing owe Gulfeagle Supply almost 4000$.

48 hours prior the court hearing for the un paid materials, Rainaway sent us the closed permit they obtained from the city (four months and half after hiring them) trough an engineer assuming all responsibility for the job and fixing the failed inspections

Rainaway roofing asked us to make the final payment, without guaranteeing us with the release of lean and payment of the materials, to waive all accusations from the material company.

On top of this, we have been told that Rainaway didn't paid the materials of other 8 jobs in the same time period, making us extremely fearful that we paid Rainaway roofing and they took the money without finalizing the material payments (as already done with the other 8 clients, that are all facing litigation for the very same reason ). At our request to please first release us from all the troubles before the release of the final payment, we have been bad mouthed, and Rainaway owner left our property badmouthing and insulting us.
