Back History On December 24, 2010 my book was released to on-line markets with ex-publisher, Publish America. This was before their alias's America Star Books and now Text Stream. Man-Tu.....was copyrighted in my name by said publisher in 2011.
Never ever received any royalties from PA. When I inquired about not receiving royalties, received nasty emails, not short of bullying. Filed a complaint with my local police department, wrote the BBB of Maryland and so on. Was told my book was not making enough money. One of my question to them was... "Why would you continue to sell a book that is not making you any money?
Much Later did receive a letter from PA that my publishing rights have been returned to me. After persistant emailing them about honoring my purchase. They also wrote that their not responsible for vendors like Amazon, Barns & Nobles selling of my book. What I was trying to express to them was that they stop listing themselves as the publisher of my book and to contact the vendors. Also had hope they would have paid me somekind of rayalty after I had purchase my rights back from them ...nada.
Tried contacting ISBN Company myself. Was told by them that I needed to contact publisher, to request that Bin numbers for my book made inactive. Publish America didn't agree. Contact Amazon. After filing infringement complaint against Textstream who are now listing themselves as my publisher, however when I went on line, read that Textstream has somehow merged with Publish America, seemingly have purchased their authors catalogs. The thing is I am no longer a Publish America/ America Star Books author, so prey tell me, how in the world did I get included with this very recent new deal?
This is enclosed in the last paragraph of my inquiry letter to amazon as it relate to copyright infringement and their response: "You have not alledged that anty of the copies of your book(s) sold on the Amazon.com website were illegally manufactured, re-copied, or otherwise unlawfully obtained when first transferred. Accordingly, we must decline your request." Signed by Garth Skoyguard Copyright/Trademark Agent Amazon.com By the way Amazon is the only one listing Textstream as publisher for my book to my current knowledge.
If a website tells you that more books are on the way by above publisher and have also added their book into a new merger, although said book was long ago purchased before merger took effect. What would you think? How would you feel. Who am I to say that new books are not being publish under previous agreement, and how can they believe that Publish America is being straight forward about the printing? So if book was lawfully printed the first time and publisher could be call the books publisher, however rights were purchase by me, so how is it lawfull for them to represent themselves as my publisher. My ex-publisher may own the bin numbers and may have own the rights to publish my book before I purchase my publishing rights from them, but they do not own the creative content, nor the publishing rights. This is one of the main reason I purchase my rights back to get them out of my life ....but they won't let go my book, which They have no rights too.. and are still getting paid, and listing themselves as current publisher under multiple alias's.
I published my book with PublishAmerica on March 24th, 2011, which changed its name to American Star Books. I have correspondence from both companies. My contract expired on March 23rd 2018, and I have tried to get in touch with the company to release my books rights to me, but I have had no response from them.
They have sold many copies of my book up to last year, but I have never received any royalties from either company. They are still selling my book on amazon and I have no control, because Amazon cannot do anything about this. I would just like to get the rights for my book.
I have republished my book on Amazon, but the publish America copy always pop up first, so their copy gets sold.
