Mr. Prabhath and Mr. Madhu pledged to facilitate this collaboration through their Indian counterpart, "Green Wings Farms Pvt Ltd," based in Kottayam.
The agreement with Mr. Prabhath and Mr. Madhu involved them securing a substantial order worth Rs. 40 crores for my products over the next three years. Payment terms with Mr. Prabhat and Mr. Madhu was an initial advance of Rs. 10 Lakhs, followed by an additional payment of Rs. 15 Lakhs after the verification of my company's credentials and another Rs. 15 Lakhs upon receiving the purchase order. It was further assured that if the deal did not materialize within the stipulated time, they would refund the Rs. 40 Lakhs.
On January 29, 2023, Mr. Prabhath requested an initial payment of Rs. 10 Lakhs, which I promptly paid to secure the orders and perform the due diligence. However, by February 18, 2023, Mr. Madhu informed me that their legal advisor pointed out that my company lacked LEI registration.
In an attempt to proceed with the opportunity, I was asked to travel to Kerala on May 6, 2023, to sign an MOU with Green Wing Farms Ltd. Unfortunately, the meeting scheduled for May 8, 2023, did not go as planned, primarily due to Mr. Madhu K's absence.
To secure the project, I sent a commercial offer for the supply and installation of refrigeration units. Mr. Prabhath then communicated that an additional service charge of Rs. 30,00,000 was required, with the promise that this payment would convince "Green Wings Farms Pvt Ltd" to advance 50% of the project cost, amounting to Rs. 20 crores, plus GST. I was then asked to send Rs. 1500,000 (Fifteen Lakhs) for the project, which he promptly did by transferring the amount to Mr. Prabhath's account. Subsequently, the balance of Rs. 15 Lakhs was paid to Mr. Prabhath, as directed by Mr. Madhu, resulting in a total payment of Rs. 40 Lakhs to Mr. Prabhath's account.
A few days later, I was notified that my company had been approved for the project, and a purchase order was issued by "Green Wings Farms Pvt Ltd." Despite these substantial payments, the promised advance payment of 50% was not delivered. Mr. Prabhath and his associates continued to provide excuses and assurances, but no financial relief was forthcoming.
As of present, eight months have elapsed since these investments were made, and I have yet to receive the promised advance payment of Rs. 20 Crores or a refund of my money. Phone calls to Mr. Prabhath and his associates go unanswered, and messages claim they are occupied with other matters.
Further investigation has uncovered concerning information about Mr. James Kuriakose and "Green Wings Farms Pvt Ltd," as well as Mr. Prabhath T. Thankachan's history of opening and closing companies, resulting in numerous discrepancies and fraud allegations. Additionally, I noticed that the purchase order mentioned one of Mr. Prabhath's companies, the website of which is not active.
Finally, we approached the HSR Police and lodged a complaint. The police arrested to Mr. Prabhath and produced to the court. The court sent him to police custody and after the custody over send him to Jail. Now further investigation is going on.
