I had taken the Notary Public test in July of 2017 in order to become a certified Notary, I had passed and in September of 2017, I was introduced to Pea M. Leano. She was the Loan Signing Agent for my mom’s refinance. Pea offered to mentor me in order to learn the skills of becoming a signing agent.
When I had met with her, she explained that she had been in the Notary business since August of 2016 and that she’s very successful; told me her process, how many signings I would be doing a day and how much I would be making working with her and that she would train me every step of the way to eventually running the business like her. I was working a full time job in Sacramento while doing the singings for Pea. The signings I was getting were in the Bay Area (San Fransisco/San Jose/ Santa Rosa) so I was up for over 20 hours every day to gain the experience I needed to do the notary business full time.
She had told me that she had 3 other employees that work in 3 different locations in the Northern California area and that I would be covering for one of the signers that was on vacation and then transition me into doing signings closer to where I lived. She gave me the answers to the loan signing test and told me “it would be better to take the class but you don’t need it. I’ll teach you everything that’s needed” At first, I had to meet with her at the signings. She always ran late to every signing.
When I agreed to work for her, she would print out the documents, I would have to drive from Sacramento to her house in Vallejo to receive the paperwork before going to the signings all over the San Fransisco area. After the signings, I had to drive back to her house to drop of the packet so she could review the documents as well. Whenever I had a question for the lender, I would have to text or call her and she would then call the lender and call me back with their response. Because I didn’t have direct contact, I would have to wait for her for however long it took.
When Pea started trusting me doing signings on my own, she still did all the work when it came to scheduling and speaking to the companies or clients. I wasn’t allowed to contact the lendor.
Within the month I had performed quite a bit of notaries earning a fair amount. I had asked her how I would be getting paid and she stated via check, after I submit my invoice to her at the beginning of each month. I had given her my statements at the beginning of each month while still doing signings and she started giving me a couple micro payments throughout the month. After 2 months of continuing to do the singings I decided to ask her what’s going on with my payments since I hadn’t received 1/3rd of the 1st months pay and we were in the 3rd month.
Every time there was some excuse LITERALLY after she tells me she has payment (i.e. the accountant is sick, one of the processors is on vacation, her debit card was compromised) So I had suggested payment through a cash app. There were still excuses. We cycled through Facebook pay, Venmo, Paypal, everyone you could think of and there seemed to still be an excuse not to pay me when I had done everything instructed. Post September she was only giving me minimal signings for the month and trying to convince me to quit to work for her full time.
After a month or so, she asked me if she could “trust me with the lendor and then eventually directly referred them to me.
By the time December 2017 rolled around she had only paid me for most of September. She had told me twice within the same week that she had received my payments and that she would give them to me that weekend. I’d received nothing and I waited a week before asking her what happened to my payments and she immediately responded that her computer had JUST broken and that she “didn’t have to do it” and that she started her company with no money and nothing else.
I decided to call the lendors accounting department and ask their accounting department about my missed payments. They stated that they have always sent out a physical check made out to her each month (since the signings are technically her and she’s the third party) The only time she has been late being paid was when she sent the invoices late to the company.
At that point, because I had been gaining experience, other notary companies were giving me assignments and I have never been late on being paid. With the new information that I had received, I told her by January 2018, if she did not pay me I would have to escalate the situation. Instead of paying me, she asked me to do more signings thinking I would forget. I told her “not until I receive 2017s pay and her response was “that’s understandable” and she never contacted me again since February 2018.
2 months after, I decided to file a small claims law suit against her for the money that she’s owed. She didn’t show up until a bench warrant was filed for her arrest a year later and she brought absolutely no documentation to prove her assets. She only apologizes for not having the money currently when she was paid accordingly 2 years ago. I will continue to keep the lawsuit going because she needs to pay.
