He sold me the following, exact wording from him:
"I can get you 1500 fresh (1hr - 12hrs old) rehab leads for the week at $200 and deliver them at the rate of 300 per day, These are opt-in direct verticals and are not call verified. The headers for the Rehab are in effect what you need as this is what your client will get. Here they are again: Date_stamp Time_stamp IP_address First_Name Last_Name Address City State Zip Email Home_Phone Alt_Phone Employment_Status Currently_Insured? Insurance_Provider Source_url SSN Date_Of_Birth"
List Received:
We called 332 "signed up leads", we only got a hold of 9, and none of them remembered signing up, and none of them were looking for rehab.
All the other phone numbers were either wrong numbers, numbers disconnected, business phone numbers, or went to voicemail. The ones we talked to were either wrong persons, wrong numbers, never signed up, and not looking for rehab.
Resolution:
Trying to resolve this issue, i issued a refund payment on Paypal: paypal did not refund me, because he put in his seller note this is a tangable product and it is not up for a refund.
When i pinged him on Skype, this is what he said (exact wording):
"Kevin, to be crystal clear, we do not call verify any of our leads. We only sell only opt-in direct verticals, which means that whatever the person filling in the application online enters is the info that appears in our leads. We don’t manipulate the data in any way. All we verify are phone numbers.
And as stated with our guarantee we would replace any DNC or wrong numbers. The problem is the individual is expecting a level of call verification which I stated from the outset that we do not do. I even offered you the next deal today at a lower price as we discussed last evening.
We don't offer cash refunds.
Kevin: I thought about the situation and what I'm can do at no additional cost to you, since our company does not refund once a file is sent.
Kevin our policy was made clear upfront. The company doesn't refund cash once file is sent. Our client is you. You told me that you refunded money to your client.
I made several offers within our company policy that go well beyond our current policy."
My Reply - and please note after that, he removed me from his Skype contacts..
yes, but you also FALSELY advertised as being SIGN UPS and real LEADS
while they are not, nobody remembers having signed up etc..
anyway, this is not the first time you have said no refunds
it's a shame you are letting this escalate for a measily $200
while i have a bunch of other customers lined up for solar etc..
as a business owner, you should also know that sometimes you invest and spend money, in order to make money
a stupid $200 refund would do you a lot more good than just refering back.
After Several calls and Skype pings after he added me back, his reply:
So let me get this straight. You now want the leads that you said were bulls***, and you tried to get the money back on Paypal. Since you were unsuccessful in getting the money back, now you want the balance of the leads that you claimed were worthless?
Try explaining that to a judge, and see what the judge says.
But to end this once and for all, I must first receive in writing from you a statement that you will not pursue by any means whatsoever a refund or reimbursement for the transaction we completed And by accepting the balance of leads, you agree to indemnify and hold harmless from any action by you or your client against Park Creek Consulting, LLC, myself personally, and any affiliates; and furthermore, you agree not to pursue any action whatsoever, legal or otherwise to obtain a refund. Once I get that in writing from you, I'll submit the order to our IT department. If your written statement is received today, you will get the complete balance of the leads by end of business tomorrow.
Regardless of the size of my company, my offer still stands. Send the release statement, and I'll send you the leads. You have till the end of business today to respond. Then the offer is taken off the table.
By your actions, you have changed the dynamics of this deal. All bets were off once you decided to escalate the situation with PayPal.
You may write what you want, but I suggest you be factual and present the full story accurately. There are laws that protect people from defamation. And damages can go well beyond $200. But that's up to you.
BOTTOM LINE - My personal experience and opinion
Speaking from my own experience, and story as explained earlier, i am entitled to my own opinion.
Regardless of the size of his company, which is highly likely a one-man show, he scammed me for a measily $200.
That is not a respectable business owner, that is a scammer and trying to rip off people.
the fact that he wanted a written statement from me not trying to harm his business etc.. that tells me this is not the first time.
Me, on the other hand, i refunded my end buyer of the leads within the hour he asked me for a refund.
