My wife and I signed a contract with Robert Birmingham to remodel our pool and pool deck. The contract was signed for $7,385.00 on August 19, 2014. The work was estimated to take 8 days and tentatively scheduled to start on August 25, 2014. We immediately paid Robert the first payment of $2,800.00.
Work actually began September 3, 2014. The pool was drained and the coping demo'd. The pool deck was also painted.
The new coping installation was not started until October 7th, 2014 and continued for another 3 weeks until October 21, 2014. No work was done after this date.
By November 27th, 2014 after numerous attempts to get Robert to finish the coping and continue working on our pool, we had to have someone else finish the coping that Robert didn't finish. Robert agreed to credit us $350.00 for having someone else finish the coping.
Robert then asked for the next payment in order to purchase the tile and other supplies. We immediately paid Robert $2,292.50. From this point forward Robert completed no further work on our pool. We continued to contact Robert and he continuously promised to work on our pool and that he would still finish it. These unfulfilled promises continued for the next 5 months.
On April 8, 2015 (8 months after signing our contract) we sent Robert a certified letter requesting that he finish all work by the end of the month (April 26, 2015) or refund us the money for work not completed. He chose to complete the project, but never actually did any work.
On May 13, 2015 Robert agreed to terminate our contract in return for refunding us $2700.00 for work not completed. My wife and I agreed to let him keep the money for the work he performed and the materials that he purchased. We just wanted the money back that we paid him for work he did not do and materials he never purchased. Robert agreed to paying us $1000.00 on May 19, 2015, $1000.00 on June 2, 2015 and $700.00 on June 9, 2015. He also promised to finish some of the touch up work on our deck, seal the deck and re-install the hand rails that he still has parts for as well as free pool maintenance for a year. He has done none of these things.
On May 22, 2015 my wife and I had to contract another pool company to finally finish our pool remodel.
As of today, October 2, 2015, 14 months after signing the contract we have only received $500.00 back from Robert. At least once a week or so Robert will promise that he will have money next week "for sure" or "without fail". He never does.
