Outlaw Beverages posted an ad on Craigslist needing Brand Ambassadors to work a 3 Day Event to sample their product to the public. Pretty standard posting, except that prior to the demos that weekend the Regional Marketing Manager requested to meet in person and have the Ambassador complete paperwork and sign a lengthy IC Agreement as well as collect direct deposit banking information which is what I did. I had to drive roughly 30 minutes each way to do this as well.
The next day roughly 16 hours prior to working the first demo she sent me a text saying that all demos were cancelled for the 3 days. I told her that was fine long as I still received payment as it was less than 24hours notice and standard in the demo world that a Brand Ambassador is still paid, I had signed an IC agreement and had the hours and work times confirmed with our email correspondance. However, she did NOT offer payment, only an apology. I explained to her that an apology is not accepted under the eyes of the law when a contract for work has been signed.
Furthermore, I told her I would be contacting the founders of Outlaw Beverages to let them know of this and would be taking legal action if the company does not pay at the end of the month as specified when hired.
As of this posting, I have written a letter to the CEO (Doug Weekes) informing him of this behavior by the Regional Marketing Manager who is representing Outlaw Beverages. Depending on the response or lack of, if I do not receive payment I will be filing a small claims for wages contracted for as well as liquidated damages.
This is the first time I have had to go to such lengths with a brand and am appalled that a company would cancel demos last minute notice and refuse to pay for services contracted for in a signed document.
I will update if I receive a response from the CEO, or payment for the contract work I was hired for.
