I would like to express my Opinion about the North Star Trucking Company
North Star Trucking, USDOT # 2094041, MC# 730485, address 1449 Maple Hills Drive, Bountiful UT, 84010 and North Star Trucking also working in the San Antonio and Three Rivers Texas area.
Owner: Mark Thompson Bountiful UT, Manager Jim Morris, San Antonio, Three Rivers, Kerrville Texas
Consider the following: If you are a Business or an Individual wanting to start working with this company (North Star Trucking).
Take time and Review the Department of Transportation Safety Measurement System, www.ai.fmcsa.dot.gov reports of DOT Violations for Lack of Maintenance, Controlled Substance and Alcohol, Personal Issues.,
Safety, Maintenance Violations over 100 violations, 78 violations on maintenance and rest on personal issues, year 2015 – 2016 and over 33 as of January 2017on current equipment, Trucks and trailers many of their trucks needing work and having DOT violations needing repairs, they wait till something happens and blames the driver as DRIVER ERROR so the cost of repairs can be paid by the employee, independent contractor or owner operator. If they can get away with charging the employee.
Also review the Controlled Substance and Alcohol, Lack of Verification of Drug Testing on Drivers, I was hired and never given a test and no one given drug testing before or during the year working for this company. Check the DOT reports on Personal Issues trucks documents not up to date or employee documents not up to date.
North Star Trucking blames the mechanical issue or incident as Driver Error when Clearly, the Lack of Maintenance and defective, old, and out dated equipment is the Issue.
I recommend you report it to the Texas Department of Transportation Complaint Department, 903 San Jacinto Blvd., Suite 1100 Austin Texas 78701 and if you are in Utah Department of Transportation Salt Lake City UT and the BBB Texas and UT
File a Wage Discrimination application with-in 90 day of leaving the North Star Trucking Company
Even if you are Owner Operators or Independent contractor or Individual employees working for the North Star Trucking Company everyone is considered an Employee of the company.
And action can be taken; you have 7 years to file a claim depending on what you have lost in the process. Contact other previous individuals working for North Star Trucking.
For Lack of Maintenance, DOT Violations or Labor Law taking pay from Employees
Group of Employees and Owner Operators and wanting to know if we have enough information to file a class action lawsuit against North Star Trucking for skimming of pay and lack of maintained equipment, blaming the drivers as driver error to pay for the lack of maintained equipment, not fixed by the company.
Currently company asked to come in on days off to work more, maybe in violation of 70 hour rule as sometimes daily rule is violated if more than three runs/loads of oil are picked up
Incident in Question and others have issues also:
My Issue, I am an employee of North Star trucking as of one year and did not sign any contract for repairs. Considered an independent contractor for paying my own taxes, Owner Operators sign contract.
I was transferred to the part of the company working for Jim Morris around November 24, 2015.
On March 25 2016, Jim Morris called me and stated they were taking funds from me for driver error, $1830 at $300 a pay period, yet previous pay roll shows they took out $100 without talking to me. I did not agree or disagree till I spoke to a Lawyer
Sometime between February 20 through February 28, 2016
Trailer # 9807 was brought to the shop to be worked on by Juan Hernandez owner operator. For brake system issues, one of the brakes had a cam-over the brakes had locked up and flipped over. The brake system was disconnected and all the brakes needed replaced.
On February 29 2016, I returned to work and was told to pickup truck and trailer at the shop in San Antonio Texas. The shop Owner Chris still needs to change the compressor and fix the rear airbags replaces brakes and drums etc. brakes would be ok with the brake disconnected and to use the trailer was, while the parts were ordered.
I had to let Chris know to lube the 5th wheel before leaving the shop
Jim Morris would have known the trailer was in for repair for brakes.
Chris from shop knew brake were not connected
Several Individuals said the brake system was not connected.
All went well for a few days, I sent a copy of the items I saw needing fixed and then on March 4 2016, I had a complete tries inspection and air pressure test on all the tires, by Loves Truck Stop giving me a read out.
The next day I started having brake problems when I turned off the truck at Kinder Morgan where we off load the oil Facility, my brakes locked.
Pressure was up to 100 psi and I had to take a hammer and bang on the drum. Second time on March 5, 2016 it happened again, this time I had to pull the lever on the rear tires to release pressure and air up again before it would release the brakes causing some damage to tires.
The rear bags do not inflate as there is a hole or something blocking the line to air it enough to lift the rear tires when truck is not loaded and the company and shop know about this.
Then the last time I tried everything I could and I forgot to release the leaver to release the brakes. I spoke to Jim Morris and he had the tires replaced and said it me it was Driver error as I did not pull the lever to release the brake system and they would consider charging me for the repairs and service call.
Yet the shop did not complete the brake service
Home time March 9-10-11
March 12, 2016 Returned to work, the brakes were fixed and I was to use the same equipment, was told 13 leaks were found and the brakes and drums were replaced, the rear bag is not replaced or the compressor. After arriving in Three Rivers Texas the hub seals had started leaking hub oil, was told to add oil till Monday
March 14, 2016 met Chris in Three Rivers Loves Truck stop and he fixed the hub leak.
On March 25 2016, Jim Morris called me and stated they were taking funds from me for driver error, $1830 at $300 a pay period, yet previous pay roll shows they took out $100 without talking to me. I did not agree or disagree till I spoke to a Lawyer
History
November24, 2015 my first day the truck would not start and it needed 3 batteries, I turned a list of 15 items needing fixed and it took about a month to get fixed.
From December 01, 2015 through February 19, 2016
I used Trailer #15 had leaks in the tank and it took two and a half months for the company to send it to be fixed I had to patch it and re-patch it every two weeks to keep it from leaking. Jim Morris was told at the start but keep putting it off till it got so bad on February 19 it was taken to Corpus Christi for repair, later found out it from the shop, had three leaks and it cost over $4000. To repair
Currently March 26, 2016
Trailer #9807 still needs work (Manufactured 3/2013 bet same brakes for several years)
ABS light not connected, DOT Violation
Several tires still need replaced DOT Violation
Three Fire extinguishers need charged and inspected DOT Violation
Window will not work on passenger side

April 10, 2016 Bad tire became flat, at well site. Called Jim and was told to drive to entrance of ranch so tire could be fixed, Tire guy arrived and replaced with warren tire, 5/32 tread bold on the sides and some tread in the middle of tire. Putting the next driver at risk, and also he may have to pay for a new tire, because he did not want to replace the tire. With good one Next day April 11, 2016 I decided to leave the company after working my two loads.
My view it’s their way for North Star trucking not paying for their equipment.
Jim Morris states it is Driver Error.
It is North Stars Lack of Maintenance Not following DOT regulations, just waiting for something to happen then blame the driver, Employee or Owner Operator. And let them pay the cost of repairs. And hold their wages.
Department of Transportation, Follow up: Look for DOT Violations
Verification of Drug test on Drivers, there is none as most drivers never took drug test, went to work
Request a review of their Maintenance records
Request their Trucks and Trailers be inspected by DOT before they start fixing items
I am still working and they plan to take funds every pay period till amount is paid, I did not agree to any amount and have not been given a settlement of the charges.
Juan Hernandez is also waiting for settlement
We may be charged for the same things.
I contacted Verizon
Court order is need to get text and pictures off of my cell phone, sent to Jim Morris for the
March 01, 2016 through March 25, 2016
May 12 Owner called and still states its driver error but will be happy to pay for most of damages let’s get this resolved.
May 12 I told him the brakes were never fixed and it is the company error and to pay the money taken $100, $300, $1131.58, and still waiting on last part of check $$1031.85 total of $2566.43 and explained that when the mechanic completed the service a week later he found 13 leaks and had replaced the brakes shoes and drums and found 13 leaks in the airline and there were still additional issues to be fixed, compressor on engine, and airbags on back tires were still bad.
In all I lost over $3000 in wages and $4000 in legal fees But I am looking for others who have had Issues with this company.
I use to work for them in 2014 out of Houston. They would take money out my check for repairs on tires and an incidents which I was not at fault.. I they took close to 5000.00. fortunate for me I kept all receipts and email correspondence of all deductions from my paayroll. When I quit I filed a claim with Texas dept work force commission.. I took a lil while but I prevailed in the end and they sent me a check for close 5000.oo.. If you work for them as a 1099 your still considered an employee because they provide all the equipment.. Only way you can be considered a contractor is if u provide everything for the job you were to contracted for.. When you sign a contract with people of this LOW CALIBER,, Reserve your rights by putting A.R.R or 1-308 this protects YOU..
