I pay child support for my daughter in Fayetteville, NC. The support comes directly out of my military retirement pay. In 2011 the NC child support enforcement did a 3 year recomp of the child support. At that time I was working a one year contract in Afghanistan for twice the salary I typically make. The recomp resulted in my support being increased by 300.00 per month. I hired a lawyer to represent me for the fact this was a one year contract, not a permenant salary. The support payments were then reduced back to the normal rate. The increase for the three months resulted in me owing back support for $1000.00. I recieved a letter from the agency stating they were going to claim the $1000.00 from my IRS tax refund. I was ok with that. I recieved my refund statement from the IRS stating the $1000.00 had been deducted for the back child support. One month later I received a letter from the NC agency stating they had performed an audit and I actually owed $500.00, not $1000.00 due to the fact that they had been deducting a small extra amount since I started paying child support to cover a back child support I owed which was from the time between the birth of my daughter and the paternity test leading to the final court ruling I was the father and beginning the support deductions. As of now the agency owes me $500.00. I called a case representative to inquire about this and she tells me they don't have the $1000.00 the IRS statement shows they do. I went to my local IRS office here in Oklahoma where I now live and they said the money was sent to the NC agency. I am seeking any assistance with this issue.
My daughter and I visited this agency numerous times over the last two years trying to establish child support for my daughter's minor child. My daughter and the baby's father are both minors which presented a problem. There is a NC Statute that allows for child support from the grandparents. The statue is NCGS 50-13.4(b). The request for child support from the paternal grandparents is what was requested. We were told first, that we could not file for this. Secondly, we were told that we never asked for support. Thirdly, we were again told that we could not file for the support because the father was a minor, which was legally incorrect. When we were finally able to fill out paperwork requesting support we were told an investagation would need to be done to assure that this agency/attorney(s) could handle this matter. We never were contacted about the investigation. We returned to the office and again discussed this matter only to be casually told how long this would take.(somewhat scarcest ally). We have yet to have this filed with the courts . Two years of legally incorrect information and apparent intentional stalling.
