NCI took $14,500 of our money wherein there is no valid contract. We attended the Plan I of NCI practice development. After the session their representative Todd and owner Bruce convinced us to enroll in the Plan II, we were hesitant because we did not have the funds at the time, we just recently started the practice.
They told us that we will only have to come up with 50% of the fee and they will finance the rest. We had applied for an SBA loan and was expecting the funds at the time. They demanded that we should give them a post dated check of $14,500 to keep our place. We signed their offer on October 12, 2015 and sent it with the check.
NCI attempted to cash the check almost immediately, and the check bounced because there was no sufficient funds in our bank account. Because we were having difficulty raising the required funds and also we could not implement the NCI Plan 2 program as constituted, we informed Todd and Bruce on October 23, 2015 that we are renouncing the offer.
NCI acknowledged our cancellation request in letter dated October 23, 2015. We thought everything has been resolved because we told them to destroy the document we signed and to not represent the check we gave them that bounced initially. To our shock and dismay NCI went ahead and withdrew $14,500 on November 12, 2015 from our bank account.
We just recently received the funds from SBA loan. We demanded the return of the funds from Mr Bruce Clark, we explained our predicament to him and Todd but they insisted that they will not return the funds, that we should do the program. Our attorney offered $2,500 as cancellation fee and they refused.
NCI kept our funds even though they did not perform any service whatsoever, they did not send us any materials, they did not send an instructor to us. Mr Bruce Clark and Todd did absolutely nothing to earn the money they took from our bank account.
To this day we are still paying back the SBA loan amount that he took from us. My partner was a religious person and he declined to take the matter to court, I wanted to but I could not do it on my own. This matter have created an enormous strain on our partnership, and financial hardship.
I would like BBB or anyone with knowledge of how we can recover this funds to help pay off the SBA loan.
