My roommate and I have been living in the unit on 1225 Island Ave, #213, 92101, San Diego, CA for the last +- 1.5 years. We’ve taken great care of the unit and it’s been maintained & cared weekly from a maid on top of our own efforts.

First, we signed a standard 1-year lease and we were approached by our realtor Lou Capuano ahead of time to renew our lease or the unit will be put on the listings for rent.

Lou presented us with 2 options:

Option 1: Month to month for $2425/m

Option 2: 1-year lease for $2400/m

We’ve opted for Option 1 going for a month to month. (I will provide a GoogleDrive Link with a PDF file containing screenshot evidence of the email threads and communication happening outside of email)

Here is when the deceit and manipulation started.

We were manipulated and mislead into changing our decision and signed a contract under false conditions. The sales representative promised us terms over the phone that he refused to put in writing and later on denied presenting.

Once, I sent our decision via 2 emails to Lou Capuano. Lou called me via phone to convince me about changing our decision of going month to month. Over the phone, Lou offered me an option for us to give 2 months in advance notice for moving out and to take responsibility help showing the unit for the duration of these 2 months for which we would be off the lease after these 2 months or if a tenant moves in before that.

He was most likely driven by performance goal or sales quota needed to hit that month/quarter for which he went above and beyond to get us lured into signing that 1 year lease. Lou stated that we cannot put those terms in the lease verbiage.

You can see below Lou and Melroy Property Management's previous deceitful & untrustworthy track record. It looks like Melroy Property Management condones this type of behavior of poorly treating & lying to their tenants. I wish I had done my research prior to buying Lou's deceitful words.

In the Gdrive link above you can see that we've provided our history of instances with Lou that showed negligence/incompetence even looking like sabotage.

We just want the terms of the agreement made by the sales rep. Lou Capuano to be honored.

Terms promised over the phone by Lou Capuano representing both Melroy Property Management and unit 1225 Island Ave, #213, San Diego, CA, 92101:

1. Release us officially from the lease as we agreed on the phone after the 2 months' advance notice, which ended on the 25th of February.

2. Refund us prorated for the remaining days of the month of February - 26th,27th,28th, and 29th. 2400/29=82.76 which equates to 4x82.76= $331.03

3. Return our security deposit in full due to the perfect conditions of the unit. We made video recordings of the storage units, appliances, faucets, walls, and floors to prevent them from robbing us out of our deposit recommended by Yelp reviewers.

4. Lou Capuano the representative of Melroy Property Management to officially apologize for misleading and lying to us in writing either via letter or email.
