1. On June 19, 2017, Ms. Kaiksow purchased a Hermes “Kelly” bag, online at luxnelle.com (the “Company”).

2. Ms. Kaiksow made two invoices payments: one on June 19, 2017 in the amount of $5,300; and a second payment on June 22, 2017 in the amount of $6,602.50. See attached invoices.

3. Ms. Kaiksow received a purple fake Chanel bag instead of the Kelly bag ordered.

4. Immediately upon receipt of the wrong bag, Ms. Kaiksow shipped it back and was promised the correct bag to be shipped.

5. However, to date, Ms. Kaiksow has not yet received the correct bag that was ordered.

6. Indeed, on or about July 9, 2017, the Company sent a FedEx tracking number to Ms. Kaiksow. However, the FedEx package was never shipped by the company, and as of August 20, 2017 showed that the item was only created. See FedEx print screen attached.

7. Ms. Kaiksow requested a refund, and on or around July 19, 2017 Ms. Kaiksow filled up the two refund forms sent to her by the Company. See refund request.

8. However, the Company advised her that the refunds were not allowed as per the Company’s policy and that Ms. Kaiksow will received store credit to apply towards another purchase.

9. Ms. Kaiksow immediately asked the Company to sent her any bag that Company had in stock and was told that one of the equivalent price would be sent. It has been well over a year, and Ms. Kaiksow has yet to be refunded her $11,500 or receive the authentic bag purchased.

10. As illustrated by the attached correspondence, Ms. Kaiksow has been in contact with a Brianna at the Company who has reassured her that a bag will be shipped. To date, no bag has ever been shipped and the Company is not responsive to Ms. Kaiksow’s request.

11. Ms. Kaskow hired an attorney who sent a demand letter.

12. The demand letter was sent via e-mail and via FedEx to the address listed on the Company’s website. FedEx attempted to deliver the letter several times, but advised us that the address was not a valid one.

13. To date, the Company has not responded nor reached Ms. Kaiksow.

14. Moreover, Ms. Kaiksow has attempted to reach the Company via phone – but the line goes to voice message directly.
