I entered into a contractual agreement with Leo Landscape Design, owner Jeremy Fetterma for monthly lawn maintenance services and was promised that my yard would be impeccably kept and that Jeremy himself would be working on my yard most of the time. I have never had a contractual agreement for monthly maintenance landscape services before I see the work produced by the landscape crew since a certain expectation must be met before I would commit to such a contract. I met with Mr. Fetterma in the Fall of 2017 and walked him around my property and explained to him in detail what type of upkeep my yard needed since it has a lot trees and is greatly shaded. I also discussed with Jeremy my discontent with the last landscape company because they were not tending to certain areas of the yard and began a project and could not finish. Jeremy assured me that his crew would have my yard looking pristine and clean, and that he himself would be out most of the time to service my yard.

After the first few service appointments I expressed my discontent with his crew's performance on October 18th stating "I don't see any cleanup of leaves"..."I feel like the yard has been like this for two weeks." Mr. Fetterma assured me that he would check on the yard and look at the progress being made. After this complaint I was unaware of any on-site inspections by Mr. Fetterma. I then had the company work on a specific area in my yard that needed stumps, plants and boulders removed and new grass planted. Mr. Fetterma charged me $2500 for this service (the area was very small) and did a good job, however his crew left a large pile of rocks and a giant boulder in one of the beds of my yard and did not haul it away. This rock pile sat in my yard for some time before I asked him to please remove it. His crew came and removed the haphazardly placed pile of rocks and left one giant boulder that was never hauled away (it is still in the middle of my yard like sore thumb).

In the meantime, my yard was still full of debris and leaves, and look very unkempt. I was embarrassed to have any type of outside gathering since the yard look like an abandoned lot. I once again expressed my discontent in November about the status of the yard and again I was assured his crew of workers was working on my yard as promised. Leo James was to have performed a Fall clean-up that was barely attempted. After repeated complaints I had to hire a third party to thoroughly clean my yard and their initial observation was that the property was being poorly tended to, the beds were not being maintained and there was debris everywhere. I was not happy about having to pay an additional company to clean up my yard, however, a crew of two people serviced my yard to an exceptional standard. I could not believe that two people were able to put my yard into top shape while a crew of Mr. Fetterma's workers left it looking very unkempt. In December I asked Mr. Fetterma to reimburse me for the clean-up crew I had to hire and that I would not be continuing as a client since my repeated complaints about the poor quality of his work went unanswered.

Jeremy answered my complaint by expressing outrage at my "insult of the way he makes a living" and asked me to make whole his entire contract since I signed a contract for monthly maintenance and I owed him the remaining months left on the contract should I decide to no longer use his services.

I told Mr. Fetterma that the contract was to protect me as well, and that in exchange for services rendered I would pay him a fee. However, he did not perform the work and it forced me to hire additional workers to get my yard in shape before the change of season. Mr. Fetterma became incredibly rude and asked me when "he should come over to pick up the check" in an attempt to bully me into paying. I am a single woman and I felt threatened and unsafe by his insistence of coming to my home to pick up a check for the remainder of the contract. He then began a series of rapid fire texts to me after which I asked him to never text me or call me again, and to place all correspondence in the form of an email.

I did not hear from Mr. Fetterma until I received notice that he filed suite against me in small claims court for the remainder of the contractual agreement even though he would not be performing any services on my yard in the future. Furthermore, the amount he has filed in small claims court is more than the amount that he initially claimed was owed by me to him.

In my opinion Mr. Fetterma is extremely unreasonable and a very difficult person to do business with. The fact that he did not offer to tend to my complaints, became combaitve and unreasonable when I expressed my discontent with the quality of his service, and then filed suit against me - the wronged customer - is outrageous. He was incredibly unreasonable upon our last interaction when I relayed to him that I had to hire a third party. His response was “you are insulting what I do for living" which is not the way to keep a customer.

Mr. Fetterma then inferred that I was being untruthful about work being done by his crew because "he equips all of trucks with GPS and can track when and where they are always." I explained to him that GPS is a measure of time and distance for things like fuel calculation, it is not a measurement of quality and cannot be used as evidence of the type of work performed. He would need to come out and walk the property himself.

I am outraged that I am being asked to pay the remainder of the contract when the services that were promised were not delivered. Not only did I pay a monthly fee for a poor job, I am now being asked to pay Mr. Fetterma the remainder of the contract. His end of the agreement was breached - therefore I did not want him as my landscaper and it is unreasonable to collect upon a contract when the requirements were not met. Furthermore, he does not deliver what he promises.
