My wife & I were ready to sign papers to buy a brand new home in Ennis, TX built by Legend Homes from Houston, TX. After the final walk-thru at the house, that's when we found out that Legend didn't even lay internet lines for the community.

Now, we realize it was up to us to do our due dillengence, but, this is 2018, not 1970, so, neither myself, my wife, & our realtor even thought of asking the agent about internet.

My wife's job from home requires the internet, so without lines she would lose her job. Also, a hot spot would not give her the amount of continuous hours of power to work each day.

Needless to say, we had to back out of the contract & explained the reason why. We were also not happy with the way our roof looked, as it was wavy, as were 3 homes next to us. Even though inspectors & roofers said it was ok, it didn't look right.

Now, we knew in the contract that it said if you opt out you would lose all earnest money. we feel, under the circumstances, Legend could have shown good faith and good public ralations by at least offering back to us, half of our earnest money, but all they offered was a hot spot.

What a lousy builder. In this day and age, you would think one of the first things you would do is prepare internet lines. We are letting everyone we know not to even look at a Legend home. STAY AWAY!!!!

There are several thing that I have been misled with by the builder

1. We had a problem with our granite counter tops in the kitchen. It had a discolored spot the day we did our walk thorugh and was told it would be fixed. They day we moved in we told our sales person we were working with from the builder Jeffrey Hymanson Sales Professional that their was another spot on the countertop that had come up and that it needed to be fixed. Bo Green the Construction Superintendent even called out the granite company Allied Stone to take a look at it and see what could be done. We were told by the granite company Allied Stone that they could darken the granite and cover the spots (there were more that had come through since we moved in) but we would not be able to use the granite for 5 days while the process was being done and to get back with them to set it up.

We told them that would be fine and would contact them to set it up within the next couple of weeks. We called the granite company Alliled Stone several times and either they would blow us off or set up a time to come out and not show up. We send have sent lots of emails to the builder complaining about the issue with the granite company Allied Stone not coming out to take care of the issue. Two weeks ago we were told by Bo Green the Construction Superintendent that we will now need to pay a trip charge and a fee to have the granite to be corrected this was after the last time the granite copmany Allied Stone did not show up.

This issue has been going on for a year now and the issue with the granite which continues to increase with the spotting and our warrenty was up on January 27, 2018 and told we were told today it was not under warrenty and well have to pay for all the work to have it fixed. I like how they waited to the warrenty has expired.

2. When we were in the process of buying the home I questioned the high taxes for Richmond Texas and was told yes they are high but once you homestead the property the taxes would decreess quiet a bit. This my family is a single income with my husband being totally being disabled so keeping cost down is a big issue for me. Well, I found out that the taxes do not really change if you homestead your property. I have done homestead and a total disability filing on my property and with both on there my taxes went down only about $80 per year which I do not consider to be a reduced rate.

I purchased a home in 2005 and was unaware of some issues with the systems. One is the AC system and the other was my dishwasher and Structural issues with the home. I had problems with the ac unit cooling and I contacted the builder who sold me the house. The builder never said contact the warrenty deparment. Their comment was we will send somebody out to look at the AC. What i did not know was there was a bigger issue being hidden by the builder. The builder knew they put in a faulty system and did a non discloser to me the buyer. It was my first home and I did not know anything about the a/c being under warrenty. The builder never spoke to me about the item that was under warrenty. I kept having problems and called John Moore to come out in 2012 to look at the system. John Moore came out and stated there is a a bigger issue the builder should not have been charing this unit. The builder should have replace the unit it is illegal in Texas to charge an ac unit. John Moore went as far as researching how many times the builder contacted their servicer Long Star to come and charge the unit. The dates are as followed. " who informed me he contacted Long Star who gave him these dates that they received calls about this unit...June 27, 2005 install date first charged.. Oct. 21,2005 another charged...and Aug 23,2007 another charge...The builder informed me that Longstar..Informed him "they came out on all these dates and charged the unit and checked for leaks only on the outside.

I contacted Legend on four different times to let them know of the issue. Legend would say I will get back with you. I never received a call. I put a home warrenty on my home for a short period of time and they charged the system and stated there is a leak. I contact legend again. It finally came to me that they defrauded me by not telling me and correcting the issue from the start. Legend knew there was a leak in the system and used Lone Star their vendor to hide all of this information. I called Legend again and now they are saying it is 2017 you purchased the house in 2005. I explain that is correct, but there is no time limit on fraud. I explained that you knew this system had a leak and you did not disclose it had a leak. You sent your vendor who would come and charge the system, but never come in upstaris to check the health of the system. The vendor knew there was a leak and did not contact warrenty or try to have the system replace this is fraud.
