I met John Nehmatallah in the fall of 2007 through a friend, I was desperate to keep my home, at this point I was fed up and running out of time with my lender and with foreclosure procedures. Wells Fargo HM had sold my home and gave me notice of the impending sale... (WHILE I WAS GOING THROUGH A REFINANCE!). I had contacted the lender and they were NOT interested in a loan modification or any mediation. I had called them moths prior to let them know that I was in hardship and to expect a late payment in the very beginning, they said SORRY...There's nothing we can do until you are 6o+ days late. I said That’s WHY I'm calling because I lost my job and two other businesses in less than two months and went through a horrible divorce.
If I could get a month of forbearance I could catch up I said. They Said "SORRY...IT DOESN'T WORK THAT WAY." I said what do I do now? They said "Get an Attorney" I said ok I will have to it seems.
MORE MONEY...So I diligently called every SCAM Artist and Parasite advertising they could Stop Foreclosures. All Scams. How the Florida Bar allows these scumbags to hold a valid license gives a much better definition of ATTORNEY by the way. During this time the buzzards were coming by in their little cars three and four times a day taking snapshots of our home and surveying our property like it’s already gone.
So, as I’m dealing with these Scam Artists attempting to get a $10,000 deposit from us AND sometimes MORE without any promise of results and meeting them only to tell me that It’s nearly impossible to change the course of this. Wells Fargo HM made HSBC an ASSIGNEE of my mortgage, and they promptly SOLD my home to an investment Group in Orlando. As I’m dealing with my wife losing her mind over this, My Mother in NY passes away and my father calls me. We drove to NY in the ice and sleet and we had the viewing, I helped settled her estate for my aging father and drove back to Florida dead tired and depressed, not knowing what I was coming home to.
We arrive home and my HOA has filed a lien on our home for my grass being uncut for a week. CAN YOU BELIEVE THIS?? The HOA Gestapo has contacted my lender and had worked with them to force foreclosure on my property to GET PAID! Reading this as I continued going up the driveway I noticed a large manila envelope taped to my door and my garage door. I opened it up expecting the worst and IT WAS! They have (WITHOUT DUE PROCESS) sold our home through HSBC and didn’t have the decency to notify us as they had done to several others in my subdivision. Some of my neighbors were spray painting their garage doors with (HELP MY HOME IS BEING STOLEN BY HSBC!)
I Promptly went to the Board Meeting at the HOA that Thursday night to arbitrate or find out how I could settle this new Fresh Hell. They said hello Mr. David Hughes could you please sign in? I said sure. Then one of the board trustees came to me and said we are sorry you can’t sit in tonight because you are no longer the owner of your home. WHAT!
So, I do what anyone else would do, I turned to a friend of mine and embarrassingly asked him for a short-term loan. I said Louis could you give me a loan for my home, I know things are tight for you too, he said anything to help you and Lisa out. “How much do you need?” I said $10,000 to bring me current. And I’ll pay you back $1000 a month plus interest. So, I go to the bank and get a bank officer to pull up my account. Oh’ Mr. Hughes I see in your account you are Delinquent and in foreclosure status, I said I know! I’m here to pay it in full. After 30 minutes he comes back and says…Oh we’re SO SORRY I CAN NO LONGER ACCEPT YOUR PAYMENT…. WHAT??
I was honestly about to give up and take a run into traffic, as it was too much to bear, I was losing not only my home but everything else, NO Home, NO Income, NO Help. This process had ruined my credit score, so I couldn’t even get a loan to bring the home current. Later that night My wife Lisa had told me that a guy I had called came by about the house, I said honey It’s probably another guy wanting pictures to put into his little resell listing, so he can scrape off our equity like they were all doing in 2007-2010 and giving people $1000 for moving out of their homes (Cash for Keys) then charging them for abandonment of their properties. This was called equity scraping. A technique used to make a ton of money getting people to leave their properties without a legal chance in hell, then sticking the EX Homeowner with damages they would never pay off. Or Pushing them to do a short sale and getting the property for next to nothing.
This was also at the time Where OBAMA Bailed out Lenders and gave them billions to keep people keep from losing their homes through debt relief. Of course, without any use of funds restrictions, they took the money and STILL threw millions of families out in the street with no regard.
So, in any event my wife finally tells me the guy’s name that came by to see me. (John Nehmatallah) I said MY GOD! Why didn’t you tell me his name honey? I called him and told him EXACTLY what had happened. He said I can help you, but we must act fast…I immediately asked, “What is this going to cost me down?” He said Nothing. I was confused.
I said Mr. Nehmatallah it has to cost something, NOBODY works for free, He told me be at his office at 8:00 am and we will get started.
I couldn’t sleep that night to say the least worrying what was to come. My wife sat up the whole night planning for the worst scenario, we had no place to go, I couldn’t move back to NY and pack us all into my father’s apartment. Neither of us had any family here.
7:00 Alarm went off and I was up gathering paperwork and the loan information on the home and at 7:40 I was at John’s Office. He said I need Power of attorney on the home, I said I have nothing to lose John, I granted him POA. He put a stack of documents on the table and he said we don’t have much time, please sign them we don’t have time to go over them, you need to go to the courts. John put purple sticky notes on each page with directions and addresses and a timeline to follow. He said go to this address at the floor on the notes and follow the instructions. I said I promise I will.
I followed the instructions to the letter and at 2:45 PM I got to my last destination and in bold black letters it said CALL JOHN. I called him from the court and Said Hi John Where do I go now? John Said Home…Your Home. I said What?
He said you are done, It’s my problem now. I said what do you mean? He said we are suing Wells Fargo NA, Wells Fargo HM and HSBC for Unlawful Practices and property theft. I said “There must be some miss understanding, I don’t have any money to sue a bunch of banks, He said “Let me worry about it”
So, over the course of the next two years, John Nehmatallah Got our home back, Settled the HOA by getting it thrown out of court by the judge, and when he called Wells Fargo they were so attentive and so forthcoming with their records, due to the massive class action lawsuits they had pending, they bent over backwards to help get that house back into our name. To this very day, John never charged me a single penny for his services from those days when I was at my wits end, and me and my wife owe him a great deal of gratitude for his hard work.
As the years went by, we also found out that he helped over 300 other people in the same position as we were in his spare time, he only asked for some technical support, which I do for my own clients.
I have since been able to give back to John Nehmatallah not only our sincere gratitude but assist him in helping others save their homes and my wife helps him with paperwork.
