We purchased the above 2011 Mini Cooper on 12/8/18. I immediately contacted the seller to speak about the car and verify that it was a "clean" car in very good condition, which I was assured that it was. The listing stated that service records were great on the car and that it was regularly maintained. Based upon those representations we quickly paid for the vehicle via bank wire transfer. Also, after purchase the seller informed me that there was a "state mandated" fee of $495 being added to the vehicle (even though there was no disclosure of hidden fees as required by state law and eBay policy).
I asked what it was for and the seller said it was for them "cleaning the car and doing their part". I questioned this and they lowered it to $150 and again said it was state mandated (I later found this out to be false). So, I sent the sale price plus the $150 as we were in urgent need of the vehcile and I promptly paid for uShip to send a bonded and licensed vehicle transport company to pick up the vehicle on 12/11. When the vehicle arrived to us this evening (12/12) we were informed by the driver that the car was not at the dealership, but at Manheim Auto Auction (Central Florida) and that was where the seller sent him to pick it up. It has multiple Manheim stickers on it stating it was to be auctioned therte on 12/12. The pictures on the listing showed the car being sold from the dealer's location, not an auto auction where problem vehicles are regularly offloaded for sale due to mechanical and other issues.
Additionally, and most importantly, when we received the vehicle this evening the check engine light is on (not divulged in the pictures even though the pics did have the vehicle running) and the transmission is inoperable. When shifting it into forward or reverse it will barely move at only a few miles per hour with little power/strength. The transmission has failed and the engine is greatly underpowered.
Lastly, the listing states that the engine is a "1.6L L4 DOHC 16V TURBO", and it is a non-turbo model. This is a serious misrepresentation that greatly affects the performance and value of the vehicle as it is not turbocharged. There are also MANY areas of the paint are chipped, even though it was represneted to us as "clean inside and out".
Dealer is refusing to pay for the drivetrain repairs.
