I bought a used 2011 Kia Soul for my soon to 16 year old daughter from Horne Kia . Fast forward to February 8th 2021, while my daughter is driving down the freeway it begins smoking heavily. I had it towed to my mechanic where is was discovered the seal blew off the transmission. Transmission fluid covered the car, and could have ignited. I thought, terrible luck. I'm a reasonable person and know there are always risks with buying used cars, and I had the bad luck of purchasing one.
Upon cleaning the vehicle out, I find the previous owners information in the glove compartment, including service records. I called Horne Kia Service department and discovered they put not one, but two rebuilt transmissions in the vehicle before I purchased it. They did not disclose when I bought the vehicle. When I called Josh Bauman the General Manager he stated that he was not required to disclose rebuilt parts in vehicles they sold and compared it to a new clutch. Horne Kia has made no attempt to do the right thing, and is ethically, morally and legally responsible for putting my child in a dangerous situation.
I was in the market for a car after mine was totaled in an accident. I was married for 21 years and EVERYTHING was in my husbands name. On October 25, 2016, I went to a car dearlership to test drive an advertised 2016 Kia Soul for $9,999. After finding the car on the lot and test driving it, I was told that the advertised car for $9,999 was no longer available (typical bait and switch). I told the salesman, Robert White, that I did not believe that I would get financing. He then assured me that I should be eligible for the First Time Buyers loan. I wanted to leave when I was stopped and told by Mr. White that a car was just brought in a few days earlier. It ws priced below what it was worth and that it was a gem!!
I test drove the 2008 VW Beetle. I asked what the price was and was told, don't worry about it. As the dealing started, a man came out with a piece of paper folded up with a monthly payment price of over $380/month. I said No. He returned with a little lower payment, $368. I said no. This continued for over an hour. Finally, the payment went down to $238/month. And I said yes if they could get me the financing. Mr. White left to speak with the financial manager, Nissa Juarez. He returned and said, "Good news!" "we were able to get you a loan as a first time buyer. Robert White the walked me to the financial office wher I would be signing the papers with Nissa Juarez.
The price of the car was $6576. Then Nissa Juarez added on a 2 year warranty for $2994. When I asked her to take it off, she told me that the people who were financing me were requiring it. After 4 hours, I finally left for home with the car. The next day, October 26,2016, Sunday, I drove to the dealership and gave Nissa a check for the down payment in the amount of $1500. I also asked her why the financing was so high, 17.99%. She told me that the company that IS financing me is being "kind of hard" on me and they want to make sure they are making a good investment.
I felt as if I had no choice and Ms. Juarez knew how desperate I was to start my life over after my husband left my daughter and I to be with a stripper. I drove the car for approximately 2 weeks before I got a phone call stating I had to come back in and sign more papers. I've bought several cars in my lifetime and this has never happend. I looked it up online and apparently this is called a "Spot Delivery Scam." A dealer tells you youre approved for financing and then they call you back and tell you it fell through. They then hold your car for ransom as they demand a higher down payment and/or a co signer. In my case they told me to bring the car back because I told them I'm not getting a co-signer nor am I giving them a higher down payment because NISSA JUAREZ outright lied to me and told me that I HAD FINANCING! AFTER I was allegedly decline for financing, NISSA JUAREZ CASHED MY DOWN PAYMENT CHECK!!!! She had No Right to cash a check for a car that I was not buying!!!
At the advise of my lawyer, I requested from Nissa Juarez, a letter from the financers outling the particulars as to why I was being declined and what they needed. If a bigger down payment was needed, I wanted Nissa Juarez to remove enirely, the warranty she was forcing me to buy for $2495.00. I believe she was not practicing ethically which explains why she did not try to call me or email me. I no longer had any trust in Nissa Juarez, so after I hadn't heard from her, I returned the car in the exact condition I picked it up in except it had gas and now Nissa is refusing to return my check. ISN'T IT CALLED THEFT WHEN SOMEONE WONT RETURN YOUR MONEY???? I just want my $1500 back so that I can purchase another car, go to work everyday and support my daughter.
