On February 22, 2023 Ben K. Waiolama came to my home to give an estimate on a roofing repair job. We spoke of other repairs and maintenance and agreed he would do the job.
Later that day Ben texted me with an estimate of costs and next day we spoke on the phone and agreed to a down payment of $1500. We were to meet on February 24 in Kapolei. On that day he introduced me to his wife Shelby, and I gave him the money. When I asked for a receipt he said he would email me one with his proposal for the job. He was on his way to buy materials from Honolulu Supply located in Kapolei.
He called me later saying there was a delay because the materials he needed were currently not on island. I understand because we live on an island and sometimes these things happen. We agreed he would start the job on Thursday, March 2. On that morning I received a text from his wife saying that he had the flu but that 2 of his workers would come later in the day and the materials were on the way. 3 pm that day he texted me that the delivery truck had a flat. Postponed job again until tomorrow.
The next day he texted me saying there was a tragic incident in his family and he had to go off island to take care of it. Asked me what I wanted to do. I said I wanted my money back and have not heard from him since.
I have filed a police report and told it is a civil matter. I was also told that this is not the first time he has done this. Also filed a complaint with DCCA which has turned it over to RICO.
I am hopeful that you can help me with this situation because people like this should not be allowed to do this repeatedly to anyone, especially seniors.
