This is a fraud complaint about freelancer named Kyle Gigabine operating on the UPWORK site and advertising his business as a Managing Member under the name G-Small Claims Consultancy & Services. On information and belief, Gigabine engaged in fraud to secure release of escrow payments for work never performed by submitting forged documents. One ticket was for $1100 (T569902889) for police report /arrest warrant and a second ticket was for $1000 (T573805404) to file civil and criminal cases. I did not realize until a few days ago that the documents were phony (ie, arrest warrant, civil/criminal complaint, court order) by sending an independent investigator to examine a nonexistent court file.
An independent investigator wrote the following: "The documents Mr. Kyle Gigabine sent you is not legitimate. The police and the Municipal Trial Court check the records and the case number in the document. They confirm that the case number in the document is not existing on their end.
There is no Regional Trial Court in Candelaria. I talked to the chief police PLTCOL Brian Merino that he did not issue the warrant and they are not giving warrant to civilians and instructed me to go to the court. The court advised me to talk to a legitimate lawyer here in Quezon because they don't want to get involved with this case without any lawyer present since it is their signature in the false documents."
When confronted, he wrote, “I need you to trust me on this one . . . I know this will work. Okay I’ll make you a bet instead . . . if you received no payments until November 14, 2023, I, myself would pay for all the expenses you had including the debt owed by Joanna and I will also be including damages, and you can sue me as well . . . for breaching of contract and misrepresentation. I will wager my name and dignity for this case . . . because I know, and I am confident to my decision is correct and the best way to do but I need you to trust me . . . , that is all I need.”
Three other independent lawyers on UPWORK examined the documents sent to release payment and replied that they were “absolutely fake. For the Warrant of Arrest, there should have been a signatory by the Judge. And for the Complaint, it should be notarized. And this decision looks nothing like it was promulgated by a proper court in the Philippines. This is absolutely alarming."
This guy is not a lawyer and is engaged in criminal activity, so needs to be arrested and prosecuted. Within the last 2 days he has shut off his phone, blocked text messages, and removed his LINKED IN profile, while putting his FIVVER account on hold. And, of course, no monies have been repaid, as this cheap scammer is now on the run.
