Made and offer to buy our house, we accepted the offer and they sent a contract the next day which we forwarded to our attorney. Process was moving along smoothly with a closing date set. I opened the house for them on several occasions for their contractors to come in to create estimates.
Shortly thereafter, they reduced their offer saying that was all they could pay. Agreed to a lower price, ammended the contract and set a closing date. Opened the house for them several more times for contractors etc. when now they want the price lowered again or cancel the contract.
We had viable offers higher than their last offer, classic bait and switch. Told our attorney to terminate the contract, we will keep the house before we let these scammers have it!
I had a house to sell. Called mark and we agreed on a price. I asked before signing contract if the price was fare of 20k. He said yes. Said property even if he had to tear down house and rebuild it the price was fair. So I said once we sign contract you won't come a month from now and say well I can only offer this. He said no. He was happy with the price. Well a month later after say he was buying at our agreed price and talking about how he was going to make a rental out of it he came with a offer of 5k since he knew I needed to sell asap. After wasting my time for a month I told him he was out of his mind to think I would sell for that price.
This was after twice contractors not showing to meet me and me wasting 2 hours waiting on them and him telling me they were just running late. To will I just leave the property open so they can just come in when they get a chance. Did that and was broke into. His word is no good. I'm writing this to warn others about how he conducts business. I seen another lady post last year and I thought well she probably was mad at them over a bad deal and at first I almost backed out. But once talking to him and the promise he made I thought ok sounds great, house sold. Big wrong. So after dealing with them a turning down offer I contacted another company and I made my sell and was happy with price. I would never call this company again.
Festivial Properties Puford Apartments LLC "Buyer” Mark Skowron On Friday, June 29, 2018 I contacted festivial properties as an investor to see if there was an interest for a particular property. There was interest in the property and a contract was sent to my email. I reviewed the contract and requested additional agreements. During the time period after receiving the initial contract, I talked to three partners under festivial properties in different time frames. The partners seemed eager for the contract to be signed and returned. Before I signed the contract, one partner named Anthony called and reviewed their process. He stated that: 1. He has 150 properties on schedule for the month of July 2. The process usually takes two weeks however it might be 3 weeks because of busy scheduling (prime time) 3. He would send a contractor out tomorrow (June 30, 2018) to walk through to property 4. He will make a note for the property closing date to be on or before July 20, 2018 5. He has been in the business for over 20 years, mentors investors, has courses 6. We should bring all contact for additional properties to him first (he’s the #1 buyer) After the conversation with Anthony I signed the Contract for Sales & Purchase of Real Estate on June 29, 2018. Since I was told that a contractor was going to do an inspection, I picked up the keys for the property from the seller, 45 minutes away to prepare for the walk through. I contacted Anthony to inform him that I had the keys. Anthony stated I will be in contact with you ASAP to schedule everything on June 30, 2018.
I have not received an update or a scheduled time as a result I contacted Anthony on July 11, 2018. I informed Anthony that the inspection period ends on July 13, 2018. Anthony responded that we will schedule it ASAP and his partner was in Alaska and not to worry we are buying the house. One week past and by Friday July, 20, 2018 I haven’t received an update, a scheduled time or a official closing date. In addition, Anthony said that he will make a note to close by July 20, 2018. I contacted Anthony again on July, 20, 2018 stating my concerns. Anthony replied let me see what’s going on with this property, I will bing you right back. Anthony did not contact me back. On July 23, 2018 I contacted Anthony for the last time stating that I did not receive an update and there was no reply.
I called and left a voicemail on July 23, 2018. I still have not received a phone call or reply. On July 24, 2018 I called another partner, Ken, from festival properties from the three contact that I talked to on June 29, 2018. I told him my issues and concerns about the process and about Anthony. Ken told me that he would look into the issue and get back with me. A few hours later, Ken informed me that nothing was apart of the property’s file accept for the contract. There were suppose to be scheduled dates for the inspection, title, and closing. He also stated that the property should have been closed by now, however it seems that the property "slipped through the cracks.” He did not understand how it happened and was apologetic. In other words Anthony "Did Not Do Anything!” All of the times that I contacted Anthony, gave him information, or ask for an update nothing was done. Anthony is a great talker but doesn’t take action! Ken then informed me and I had two options:1. Cancel the current contract or 2. Extended the contract for three weeks to "start over the process " Ken told me to review the options and give him a call later. Later that day on June 24, 2018, Ken stated that he went over the comps and the property is not worth investing into. How is not worth investing into when the company made an offer and signed the contract? The information I received should have been found within the inspection period.
Festivial Properties put properties under contract with a specific offer without first understanding the comps, ARV, repairs, and the potential profits (running the numbers). This is done after the contract is signed. If the numbers does not add up, then there is no response when to try to contact the partners. Since Anthony did not go through the process of a title search and opening escrow with earnest money, the contract was not legally binding. Anthony wasted a month of my time, effort, Money and in particular my Credibility!!!! Based off of my experience I would have to rate this company a Negative Five (-5). Although this situation was solely on one individual, I believe the company should have found a solution to accommodate my situation which has not been done. This lack of care and inconsideration will unfortunately effect my business.
