Fay Servicing,kept adding fees to a mortgage and refused to work with an heir on mortgage of orgional loan of aproximate 28,286 dollars and when I as heir sold the property they kept adding fees and changing payoff amounts until the payoff was almost the orgional loan amount after almost 16 years of payments and refused payments just so they could add extra fees. Force placed insurance on multiple occasions even after I obtained property insurance, then took over my insurance after asking me by letter to obtain insurance . then my insurance sent me my payment back then canceled . Fay servicing put a whole year of forced insurance on property and billed into negative escrow multiple times within serval months,just to create fees so no payments would apply to principle , They even refused to protect the property from storm damage with their forced insurance to protect the deweling and let it deteoriate/uninhabitable to were the property value drastically decreased. Their charging the consumer for the forced insurance but wont use it. in my opinion this is fraud on Fay Servicing to collect insurance monies and not use them when needed. They also refused complete payment history to heir on mortgage from orgional loan date saying they dont know what has been paid on mortgage and dont have the information. IF they bought the mortgage they have it!!!
A person just doesnt pay on a mortgage for 15 plus years for the balance to be almost the orgional loan amount. Fay Servicing would refuse to speak with me as heir and new owner of property just to create extra fees .Fay servicing said they couldnt talk to me as heir even with all legal noterized documents and even the deed in my name. they would contact me multiple times in one day by phone and verify my information just to say we cannot discus the account with you. This in my opinion is wrongdoing and skimming money from people by bogus charges. When I sold the property to sale the small estate and Fay Servicing found out I was selling they sent out multiple differnt payoffs. but the title company said they had to go with the larger payoff
A payoff just doesnt change serval thousand dollars in a couple months. Fay servicing also would not stick to orgional loan contract and kept changing payment to increase fees etc
The staff is extremly rude when calling and will give difernt answers on the same topic and when you draw it to their attention they hang up on you.
I feel like I have been drastically Scammed by Fay servicing as well as family members.
Somethig needs to be done with this company and our goverment agencies need to get involved as well as investigative consumer reporters. ENOUGH IS ENOUGH with FAY SERVICING
Payment was submitted by me to Fay Servicing on 3-28-2022 in the amount of $182.53, check # 7602. Check was returned by them with a letter dated 4-5-2022 stating "your account is in active pre foreclosure or foreclosure status. we are unable to accept anything less than full payment due.
Fay Servicing LLC Mortgage statement dated 3-10-2022 indicates clearly the next payment due is 5-1-2022 in the amount of $65.06 with NO indication of arrearages. I called on 4-13-2022 and after 16 minutes the customer disservice rep hung up as I was insisting to talk to a supervisor in a loud voice since she had broken English and was extremely hard to understand. I was very aggravated by this time since I was getting stone walled being told I was represented by an attorney and they could not talk to me regarding this matter.
I told them they needed to check the bankruptcy records and she kept arguing with me. This loan has had several servicers over the years with no problems. Fay Servicing took over the servicing around December 2021 and had accepted 4 of my payments in the amount of $182.53 each for December, 2021, January thru March 2022 with no problem, no mention of being behind and sending a statement as mentioned dated 3-10-2022 that next payment due was 5-1-2022 for $65.06.
My guess is that some inept untrained individual working for Fay Servicing improperly booked the loan or it is a bigger issue of predatory loan servicing. My concern is that they should be investigated to see if there is a pattern of this type of outrageous treatment of trying to place current on time paying customers into a delinquency status to perpetrate fraud and predatory servicing and subsequently foreclosing on their properties by returning their payments then when you try and call to resolve the issue they stonewall you and force you to hire an attorney.
If Fay Servicing is that incompetent in being able to service loans and can't properly document the status, then they should be banned, sanctioned and forbidden to service loans at the very least in Florida...I have resubmitted my returned payment by certified mail to the address on the 4-5-2022 letter from them. I certainly do not want my credit reporting from them to be affected for no wrong doing on my part.
Perhaps since I am over 60, they act as predators on the elderly thinking they don't have all of their faculties but I have all my records. I now have over 8 hours of my time and have suffered emotional distress and expended time and money to correct their inept actions in this matter. If I am in foreclosure , I need to see why, when etc.
since statements from them show my being paid ahead. I would appreciate any help you can provide in this matter so they don't screw me out of my property by kicking back in full payments made by myself.
