In May, 2013, we bought a home in Blairsville, Georgia. The home inspector, we hired, was negligent and missed almost $20,000 worth of problems. In a panic, we made the mistake of hiring Francis Earl Wiggers to sue this inspector and get money for the repairs. A word to all readers out there, Never, hire anyone - especially a lawyer - when you are upset and distressed. In mid June, 2013, we gave this lawyer a $2,000 retainer, which we assumed he would use for expenses of the case. The first sign of trouble, is when he told us to call a mold inspector to make a report. We told him to take that $275 fee from the $2,000 we gave him. He told us to pay for it ourselves, which we did. In hindsight, we now see that the $2,000 went into his pocket, and we would be out alot of money and have grief as well. In short, we paid for this lawyer to be rude, mean and belligerant towards us - me especially. To make a long story short, here is what happened:
Wiggers never filed any lawsuit against the inspector. He never even bothered to see if the inspector had any insurance which would pay for his negligence. He told us to file a claim against our Homeowner Insurance - Travelers. We stupidly did so. Any lawyer, with any smarts would know that any insurance company with a new insurance policy, would NEVER pay for pre-existing conditions. After weeks of nothing happening, we talked to two people, - both of whom have had negative experiences with this lawyer. Same thing as us - took retainer money, and failed to move the case forward. We decided to ask him to withdraw from the case, give us back most of our money, so we could find another lawyer. Wiggers refused to give us back a penny -saying it was all used up. We spoke to the State Bar of Georgia, who said we had a right to get a billing statement. We asked for one. That billing statement was full of untrue statements, and things he claimed to have spent the money on, which were impossible to believe. I asked him, if he would - at least - take the rest of the case on contingency, since we did not have any more money to give him. Also, we were spending good money on making repairs to the home. Again, he refused to take the case on contingency. I asked him, WHY NOT? This miserable lawyer said, BECAUSE I DO NOT WANT TO WASTE MY TIME TALKING TO YOU! Dear Readers, I ask you, would you spend $2,000 just to get insulted and mis-treated by this lawyer or any lawyer? This is exactly what happened to us. I called the State Bar of Georgia - another miserable experience - and filed an ethics complaint against Wiggers. After 1 year - back and forth - The Bar Found No Wrong Doing on the part of Francis Earl Wiggers -saying he is a member in Good Standing. That means he pays his Dues on Time. I have written a review on the State Bar of Georgia, in the past. They are no more than an Association For Lawyers, Of Lawyers and By Lawyers. They are not even a State Agency. They exist to protect the lawyers. Believe me, the odds of getting the Bar to find for the citizen are less than 1/2 of 1 percent. Very appalling odds indeed. Back to Wiggers: We took this lawyer to Magistrate Court in January, 2014 to try to get our money back. The judge, Allen Wiggington was a personal friend of this lawyer. Thus, even though I had all the evidence in the world, there was no way to win in that court. This judge, allowed this lawyer to "run the courtroom", and said that he would have granted the lawyer a counter claim if he had filed one against us. Imagine that - two seniors getting ripped off by a negligent home inspector, have a lawyer steal our $2,000 retainer money - then have a "good old boy" judge attempt to rip us off even more.We tried to file a Fee Grievence against Wiggers with the State Bar of Georgia, but this Rita Payne (of the Bar) refused to grant us this grievence because we took the lawyer to court. From their track record, I bet, they would have found in favor of this lawyer anyway. Georgia is the wrong place to be a ripped off Citizen. It is a State of CAVEAT EMPTOR - LET THE BUYER BEWARE. In the finaly analysis, this whole horrible experience, has left a bitter taste for us. It is ashame this Francis Earl Wiggers treated us so badly and did nothing to move our case forward. Even, if given more time, I do not think he would have done anything, except accumulate more FAKE charges. It is a double shame that he got to keep our money - which we needed so desperately to make repairs on the home. After all, we were living on fixed income - month to month. After 10 miserable years in Georgia, we moved out of Georgia.
