It is stated that I took out a pay day loan on July 31, 2015 in the amount of $350.00 and now the outstanding balance is $531.39. I am now being summoned for violation of federal banking regulations and collateral cheque fraud.
The entire cost of the lawsuit is $2579.97 which includes initial loan amount, delay charges, interest, attorney's fee and case registration charge. It states that I must answer to the comlaint by January 18, 2019. It includes my SSN, address, and an old telephone number.
I have never taken out a pay day loan and would not have taken one out in the State of California being that I am a resident of Georgia. I feel like this is a case of identity theft.

B. Application of Payments

II. COLLECTION COSTS

III. DEFAULT
If any of the following events of default occur, this Note and any other obligations of the Borrower to the Lender, shall become due immediately, without demand or notice:

IV. SEVERABILITY OF PROVISIONS

V. MISCELLANEOUS
All payments of principal and interest on this Note shall be paid in the legal currency of the United States. The Borrower waives presentment for payment, protest, and notice of protest and demand of this Note.
No delay in enforcing any right of the Lender under this Note, or assignment by Lender of this Note, or failure to accelerate the debt evidenced hereby because of default in the payment of a monthly installment or the acceptance of a past-due installment shall be construed as a waiver of the right of Lender to thereafter insist upon strict compliance with the terms of this Note without notice being given to Borrower. This Loan Agreement, Promissory Note, and Security Agreement is entered by and between CREDITOR/LENDER and BORROWR/DEBTOR as of the above date, subject to the terms and conditions set forth and any and all representations BORROWER has made to LENDER in connection with
this transaction.
LOAN AGREEMENT: You have requested a loan (the “LOAN”) in the amount of the Amount Financed stated above (the “PRINCIPAL”). At your specific request, we as LENDER do hereby advance to you the Principal Amount. This loan is offered under the Laws governing money, interest and usury. You as BORROWER shall pay in cash to LENDER the amount set forth by the instalment schedule above when due pursuant to the
Promissory Note. Any notice that we as LENDER are required to provide you pursuant to the Agreement and/or the Uniform Commercial Code of the State of California will be deemed reasonable if sent to you at the address set forth by you above at least five (5) days before the event with respect to which notice is required. In the event the loan is repaid prior to maturity, BORROWRE shall pay interest at the rate set forth as the ANNUAL PERCENTAGE RATE above for the number of days the loan is outstanding and there will be no prepayment penalty. The amount set forth above as the FINANCE CHARGE is deemed a service fee by California law and is not interest.
I. TERMS OF REPAYMENT
A. Payments
Unpaid principal after the Due Date shown below shall accrue interest at rate of 45% monthly until paid. The unpaid principal and accrued interest shall be payable in four bi-weekly installments of $228.00 starting from September 25, 2016.
B. Application of Payments
All payments on this Note shall be applied first in payment of accrued interest and any remainder in payment of principal.
C. Late Fee
The Borrower promises to pay a late charge of $39.00 for each installment that remains unpaid more than three day(s) after its Due Date. This late charge shall be paid as liquidated damages in lieu of actual damages, and not as a penalty. Payment of such late charge shall, under no circumstances, be construed to cure any default arising from or relating to such late payment.
D. Discount
If the principal and accrued interest are paid in full on or before December 15, 2016, the Borrower shall be entitled to refund of part of the finance charge.
E. Acceleration of Debt
If any payment obligation under this Note is not paid when due, the remaining unpaid principal balance and any accrued interest shall become due immediately at the option of the Lender.
II. COLLECTION COSTS
If any payment obligation under this Note is not paid when due, the Borrower promises to pay all costs of collection, including reasonable attorney fees, whether a lawsuit is commenced as part of the collection process.
III. DEFAULT
If any of the following events of default occur, this Note and any other obligations of the Borrower to the Lender, shall become due immediately, without demand or notice:
1) The failure of the Borrower to pay the principal and any accrued interest when due;
2) The liquidation, dissolution, incompetency or death of the Borrower;
3) The filing of bankruptcy proceedings involving the Borrower as a debtor;
4) The application for the appointment of a receiver for the Borrower;
5) The making of a general assignment for the benefit of the Borrower's creditors;
6) The insolvency of the Borrower;
7) A misrepresentation by the Borrower to the Lender for obtaining or extending credit; or
8) The sale of a material portion of the business or assets of the Borrower.
IV. SEVERABILITY OF PROVISIONS
If any one or more of the provisions of this Note are determined to be unenforceable, in whole or in part, for any reason, the remaining provisions shall remain fully operative.
V. MISCELLANEOUS
All payments of principal and interest on this Note shall be paid in the legal currency of the United States. The Borrower waives presentment for payment, protest, and notice of protest and demand of this Note.
No delay in enforcing any right of the Lender under this Note, or assignment by Lender of this Note, or failure to accelerate the debt evidenced hereby because of default in the payment of a monthly installment or the acceptance of a past-due installment shall be construed as a waiver of the right of Lender to thereafter insist upon strict compliance with the terms of this Note without notice being given to Borrower. All rights of the Lender under this Note are cumulative and may be exercised concurrently or consecutively at the Lender's option.
This note may not be amended without the written approval of the holder.
VI. GOVERNING LAW
This Note shall be construed in accordance with the laws of the State of California.
VII. SERVICE FEE CALCULATIONS
The limits on the service fees for payday loans are based on the amount of the loan. The payday lender may charge up to 15% on the first $100.00, 14% on the second $100.00, 13% on the third $100.00, 12% on the fourth $100.00, and 11% on the fifth and sixth $100.00. They sent me an email saying that I owed them money from some payday loan that i did not take out. They are also threatening to take out money from my paycheck to pay for this "loan". And I know for a fact that I did not take out a loan with them.
I received an email claiming a court order being filed against me for unpaid payday loan from this company. I have NEVER applied or received funds from this place.
A Robert Wallace emails me from [email protected] with my social and a phone number from 2004 address from 2006 and checking account from 2010 so I believed it I almost paid him 50 dollars but then I asked for proof and he wouldn’t answer the questions.

It is stated that I took out a pay day loan on July 31, 2015 in the amount of $350.00 and now the outstanding balance is $531.39. I am now being summoned for violation of federal banking regulations and collateral cheque fraud.
The entire cost of the lawsuit is $2579.97 which includes initial loan amount, delay charges, interest, attorney's fee and case registration charge. It states that I must answer to the comlaint by January 18, 2019. It includes my SSN, address, and an old telephone number.

I knew that I didn't receive one, they also used an address that I haven't been associated with over 10 years now, a phone number that I have never had, and had all the numbers for my social security, but not in the correct order. Although I was very concerned about it, I am so glad that I did my research on this!! After examining the email, there isn't a phone number associated anywhere on the paperwork, which was my first clue. Because truth be told, I was going to call them and give me a piece of my mind. This past Monday, I received an email from a Richard Duckett, claiming that I received a pay day loan on July 25, 2014, and never paid it. I found this suspicious, since I NEVER put in for ANY pay day loan from ANY company during this time, and I responded by sending them a cease and desist letter. This was their response below:
We apologize for the inconvenience, but we will have to proceed with legal measures. Despite sending you several reminders, we have received no response from you about your seriously past due account. We feel we have given you ample time and have been more than patient with you.

I. TERMS OF REPAYMENT
A. Payments
Unpaid principal after the Due Date shown below shall accrue interest at rate of 45% monthly until paid. The unpaid principal and accrued interest shall be payable in four bi-weekly installments of $228.00 starting from September 25, 2016.
B. Application of Payments
All payments on this Note shall be applied first in payment of accrued interest and any remainder in payment of principal.
C. Late Fee
The Borrower promises to pay a late charge of $39.00 for each installment that remains unpaid more than three day(s) after its Due Date. This late charge shall be paid as liquidated damages in lieu of actual damages, and not as a penalty. Payment of such late charge shall, under no circumstances, be construed to cure any default arising from or relating to such late payment.
D. Discount
If the principal and accrued interest are paid in full on or before December 15, 2016, the Borrower shall be entitled to refund of part of the finance charge.
E. Acceleration of Debt
If any payment obligation under this Note is not paid when due, the remaining unpaid principal balance and any accrued interest shall become due immediately at the option of the Lender.
II. COLLECTION COSTS
If any payment obligation under this Note is not paid when due, the Borrower promises to pay all costs of collection, including reasonable attorney fees, whether a lawsuit is commenced as part of the collection process.
III. DEFAULT
If any of the following events of default occur, this Note and any other obligations of the Borrower to the Lender, shall become due immediately, without demand or notice:
1) The failure of the Borrower to pay the principal and any accrued interest when due;
2) The liquidation, dissolution, incompetency or death of the Borrower;
3) The filing of bankruptcy proceedings involving the Borrower as a debtor;
4) The application for the appointment of a receiver for the Borrower;
5) The making of a general assignment for the benefit of the Borrower's creditors;
6) The insolvency of the Borrower;
7) A misrepresentation by the Borrower to the Lender for obtaining or extending credit; or
8) The sale of a material portion of the business or assets of the Borrower.
IV. SEVERABILITY OF PROVISIONS
If any one or more of the provisions of this Note are determined to be unenforceable, in whole or in part, for any reason, the remaining provisions shall remain fully operative.
V. MISCELLANEOUS
All payments of principal and interest on this Note shall be paid in the legal currency of the United States. The Borrower waives presentment for payment, protest, and notice of protest and demand of this Note.
No delay in enforcing any right of the Lender under this Note, or assignment by Lender of this Note, or failure to accelerate the debt evidenced hereby because of default in the payment of a monthly installment or the acceptance of a past-due installment shall be construed as a waiver of the right of Lender to thereafter insist upon strict compliance with the terms of this Note without notice being given to Borrower. All rights of the Lender under this Note are cumulative and may be exercised concurrently or consecutively at the Lender's option.
This note may not be amended without the written approval of the holder.
VI. GOVERNING LAW
This Note shall be construed in accordance with the laws of the State of California.

The limits on the service fees for payday loans are based on the amount of the loan. This Loan Agreement, Promissory Note, and Security Agreement is entered by and between CREDITOR/LENDER and BORROWR/DEBTOR as of the above date, subject to the terms and conditions set forth and any and all representations BORROWER has made to LENDER in connection with
this transaction.
LOAN AGREEMENT: You have requested a loan (the “LOAN”) in the amount of the Amount Financed stated above (the “PRINCIPAL”). At your specific request, we as LENDER do hereby advance to you the Principal Amount. This loan is offered under the Laws governing money, interest and usury. You as BORROWER shall pay in cash to LENDER the amount set forth by the instalment schedule above when due pursuant to the
Promissory Note. Any notice that we as LENDER are required to provide you pursuant to the Agreement and/or the Uniform Commercial Code of the State of California will be deemed reasonable if sent to you at the address set forth by you above at least five (5) days before the event with respect to which notice is required. In the event the loan is repaid prior to maturity, BORROWRE shall pay interest at the rate set forth as the ANNUAL PERCENTAGE RATE above for the number of days the loan is outstanding and there will be no prepayment penalty. The amount set forth above as the FINANCE CHARGE is deemed a service fee by California law and is not interest.
I. TERMS OF REPAYMENT
A. Payments
Unpaid principal after the Due Date shown below shall accrue interest at rate of 45% monthly until paid. The unpaid principal and accrued interest shall be payable in four bi-weekly installments of $228.00 starting from September 25, 2016.
B. Application of Payments
All payments on this Note shall be applied first in payment of accrued interest and any remainder in payment of principal.
C. Late Fee
The Borrower promises to pay a late charge of $39.00 for each installment that remains unpaid more than three day(s) after its Due Date. This late charge shall be paid as liquidated damages in lieu of actual damages, and not as a penalty. Payment of such late charge shall, under no circumstances, be construed to cure any default arising from or relating to such late payment.
D. Discount
If the principal and accrued interest are paid in full on or before December 15, 2016, the Borrower shall be entitled to refund of part of the finance charge.
E. Acceleration of Debt
If any payment obligation under this Note is not paid when due, the remaining unpaid principal balance and any accrued interest shall become due immediately at the option of the Lender.
II. COLLECTION COSTS
If any payment obligation under this Note is not paid when due, the Borrower promises to pay all costs of collection, including reasonable attorney fees, whether a lawsuit is commenced as part of the collection process.
III. DEFAULT
If any of the following events of default occur, this Note and any other obligations of the Borrower to the Lender, shall become due immediately, without demand or notice:
1) The failure of the Borrower to pay the principal and any accrued interest when due;
2) The liquidation, dissolution, incompetency or death of the Borrower;
3) The filing of bankruptcy proceedings involving the Borrower as a debtor;
4) The application for the appointment of a receiver for the Borrower;
5) The making of a general assignment for the benefit of the Borrower's creditors;
6) The insolvency of the Borrower;
7) A misrepresentation by the Borrower to the Lender for obtaining or extending credit; or
8) The sale of a material portion of the business or assets of the Borrower.
IV. SEVERABILITY OF PROVISIONS
If any one or more of the provisions of this Note are determined to be unenforceable, in whole or in part, for any reason, the remaining provisions shall remain fully operative.
V. MISCELLANEOUS
All payments of principal and interest on this Note shall be paid in the legal currency of the United States. The Borrower waives presentment for payment, protest, and notice of protest and demand of this Note.
No delay in enforcing any right of the Lender under this Note, or assignment by Lender of this Note, or failure to accelerate the debt evidenced hereby because of default in the payment of a monthly installment or the acceptance of a past-due installment shall be construed as a waiver of the right of Lender to thereafter insist upon strict compliance with the terms of this Note without notice being given to Borrower. All rights of the Lender under this Note are cumulative and may be exercised concurrently or consecutively at the Lender's option.
This note may not be amended without the written approval of the holder.
VI. GOVERNING LAW
This Note shall be construed in accordance with the laws of the State of California.
VII. SERVICE FEE CALCULATIONS
The limits on the service fees for payday loans are based on the amount of the loan. The payday lender may charge up to 15% on the first $100.00, 14% on the second $100.00, 13% on the third $100.00, 12% on the fourth $100.00, and 11% on the fifth and sixth $100.00. Therefore, the following service fee limits apply:

They sent me an email saying that I owed them money from some payday loan that i did not take out. They are also threatening to take out money from my paycheck to pay for this "loan". And I know for a fact that I did not take out a loan with them.
I received an email claiming a court order being filed against me for unpaid payday loan from this company. I have NEVER applied or received funds from this place.
A Robert Wallace emails me from [email protected] with my social and a phone number from 2004 address from 2006 and checking account from 2010 so I believed it I almost paid him 50 dollars but then I asked for proof and he wouldn’t answer the questions.
