I met Nicolas “Nick” Flores through friends in San Antonio, Texas around September 2022. He said that he was an appliance supplier. I needed appliances for rental units. He said that he supplied appliances for new, large apartment buildings and ordered hundreds at a time, and that could use his bulk purchasing discount to provide me with a smaller order at the same bulk price. We started with an order for three sets of Whirlpool stainless steel appliances. Nick said he could have them delivered within a couple of weeks for $5,839.01 but he needed the full payment up front in order for me to join in on his larger order. He said he could not accept credit card payments. He sent me an invoice from his company Extra Development and I sent him a Zelle payment on October 13, 2022 for the full amount. Nick told me that he placed the order.
On October 14, 2022 Nick texted me saying that my order was confirmed and he would have one set delivered to me on October 19, 2022 and two sets on October 24, 2022.
On October 19, 2022, Nick contacted me asking if I would be interested in two sets of “open box” black Fridgidaire appliances that another client returned. He quoted me another $3,134.92 and again required the payment up front to secure the order. Since the other appliances were on the way, I agreed and sent Nick a Zelle payment. I asked him for the delivery status on the first sets of appliances and he said that a set would be ready by that Friday, October 19, 2022.
After several delays, the first order that was originally supposed to have been delivered on October 19, 2022, showed up on October 27, 2022 as an incomplete set. I was not there to personally supervise the installation and was not aware that it was an incomplete set until weeks later.
A couple days after the first delivery, I called Nick for an update. He told me that while he was delivering the first stainless set on October 27, our staff on site told him we urgently needed two more sets of black appliances and a couple of dishwashers otherwise tenants couldn’t move in. Nick said that he could update my pending order for black appliances to help. I confirmed with our staff that the need was urgent, and because I believed that Nick already delivered one complete set, I agreed to the add-on to my order with Nick’s assurance that all orders would be fulfilled as promised.
After realizing that the one and only set that was delivered was incomplete, and after several weeks of excuses for his failure to deliver the remaining sets, On November 14, 2022, I left Nick a voicemail and a text asking for a refund. Nick apologized for not being able to fulfill his promises and guaranteed a full refund. He said he would send me an email confirmation and figure out the fastest way to deliver a full refund.
On November 18, 2022, Nick sent a refund invoice on his Extra Development letterhead, but not a refund. After several weeks of trying to get payment, and excuse after excuse, by December 2022, Nick Zelled $500, and then another $500. This was the total amount he returned of the $12,173.93 I ultimately paid him.
After several more weeks of excuses, ignored calls and ignored texts, my attorney got in touch with Nick, and Nick promised my attorney that he would pay in full the next week, January 10, 2023. Weeks past the deadline, Nick has not responded to any voicemails or texts.
