On January 29th 2023 we had booked a reservation with the extended suites. We had stayed there previously around the 29th of November of 2022 only once. Upon arrival we were notified that we were put on the do not rent list. My partner is 30% disabled with a service animal and a veteran I myself am a veteran and will be 100% disabled after probably the 15th of February as I suffer from a serious heart condition as well as circulatory issues. We are homeless and have been in this vehicle for 2 weeks not showered for 2 weeks and me at a seated position with my feet swollen and extreme amounts of pain due to blood clotting and blood pooling really we're looking forward to staying. When I asked them why we were put on the do not rent list they said because our service animal had used the bathroom and we did not pick up after it when I pulled out the Arizona laws on putting a person on the do not rent list to showing them that we had not violated any laws even had we not picked up after our animal they refuse to let us stay however after taking several pictures showing the conditions of the property the trash as well as the animal feces they allowed us to stay. The following morning after we had paid for another two nights stay in the room that we had rented my partner went downstairs to redo the keys the person behind the front desk try to charge for the pet however it's not a pet it's a service animal and protected by federal law my partner is very timid and so I am forced often as is to deal with these situations because she does not know how to deal with them herself and to be remaining objective yet firm so I went down there and I spoke to the person who had put us on the DNR list.

When I asked her why she stated that somebody or two individuals have come up to her and told her that my service animal was walking around upstairs defecating on the second and the second level. When I first told her that it's a service animal not a pet that the service animal must be tethered to me at all times meaning on a leash when not in my own personal space and that it would be a violation of law to have my service animal wandering freely defecating upstairs and also told her that we were not on the second level we were on the third level she said it didn't matter. When I told her that I would like to see the hotels policies on this putting people on DNR list because hotel policies do not override state law she said it does. When I asked her to see the footage she said she had it but then when I requested it she said she didn't have it when I asked to see the hotel policies she didn't have that either so when I asked her, so you mean to tell me that my service animal in my possession defecated upstairs I did not clean it up and you put me on a DNR list I said that's preposterous because he's house trained he wouldn't do that I said are you telling me that my service animal had an accident I cleaned up after it and you put me on the do not rent list both are not reasons to have a person put on the do not rent list. When I brought up the fact she tried to charge $100 for the animal she said it's a non pet friendly place and that the cost of having to clean up after a pet was timely. I remind her again it is not a pet it is a service animal which is protected under the Americans with disabilities act and it's a federal law it's a federal crime to violate that law she said it did not apply. At which point she became quite belligerent with me and I walked away.

At about 11:30 that night a man comes banging on the door demanding to talk to my partner he told me that I did not belong there however I am registered as a guest and he said we did not pay and I said yes we did he wanted to discuss the fact why we had not moved rooms I said because we paid for two nights in this room two additional nights in addition to the night that we paid he said we did not I thought it was about the service animal so I pulled out AS11-1034 clear standing with Arizona state laws are in regards to disabilities persons with disabilities act and a person with a service animal he did not care he said but I told him my partner was in the shower he told me that I was refusing to allow him to speak to her and he proceeded to call Tempe pd. My partner called Tempe PD as well and I asked her to do so as I contacted Tempe PD but they were not very helpful so I contacted the veterans crisis line. I was on the phone with the veterans crisis lines they were giving me advice on what to do and how to handle the situation the first officers that showed up were somewhat cordial and nice after they took my partner downstairs for quite some time I became uncomfortable and I decided to go look for her but she was coming up and she stated to me that we had to leave however the police told them because it's a civil matter because we had already paid for the room that they could not force us to leave and that they could not arrest us. Due to my severe health condition which has been exasperated because of the situation I decided that we would leave in the morning not then because she was under medications and I cannot drive and I cannot be in that car and I was exhausted well on the phone with the veterans affairs there was banging on the door was Disturbed the service animal and constantly banging the disturbs myself as I suffer from complex trauma and PTSD 3. After I got off the phone with the VA who was instructing me not to speak to them I realize the banging was the police. I was speaking to them through the door trying to explain the situation time that I wanted to leave but they demanded that I opened the door when I told them it's a civil matter that they cannot arrest me they became even more irate pounding on the door eventually they made entry with their guns drawn discussing amongst themselves bomb rushing me. They proceed to make entry to take me into custody and although I was not resisting arrest I was not allowing them to put me in chokeholds as I know how to defend myself quite well at one point I contemplated hurting them which I could have done very easily but I thought it would not be in my best interest to do so. As I am well trained and hand-to-hand combat techniques and I could have very easily broken their femur bones and much worse. They tried to subdue me but I was simply out maneuvering them that's all I was doing there was no real exertion on my part but they were struggling at one point they put me in a chokehold I was able to stand up with them I told them that I have a heart condition and that my heart will go into cardiac arrest they did not believe me they put a taser to my neck telling me they're going to tase me they drew their guns and pointed them at my partner and at my service animal threatening to shoot my dog. They eventually took me into custody they were extremely disrespectful rude condescending remarks calling me a liar belittling me baraging me abusing me the one officer had the audacity to need me in my heart place his knee over my heart need me in the rib cage need me in the shoulders attempted to need me in the head but I blocked it with my shoulder and he to need me in the neck. All because a hotel who violated state law violated federal law violated my civil rights would not back down and abide by the law by allowing me to stay for a room that I'd already paid for but we're angry because I called them out on their lies and they use the police to abuse me. I really hope somebody is reading this I really hope this is not a waste of my time I've already written to the mayor I'm going to be filing a federal charge against the employees of this hotel and I'm filing a grievance against the police because up until last night I trusted them in the extent that they would uphold the law but even the police when I told them here's what the Arizona statute State about this situation they told me they did not care and that shocked me here are the police who deal with criminal matters this was a civil matter they should have simply left but they did not nevertheless they're supposed to be there to uphold the law we're there to uphold the violations of federal law by a hotel that violated her right as a disabled veteran discriminating against a service animal and the police took their side. U.S. Dept of Justice v. Defendant Jason Michael Schubert.

Charges have been filed against defendant Jason Michael Schubert. The lead prosecutor of the case is Matt Devlin. The main charge is categorized as Securities Fraud.

This prosecution involces a national scheme, begining as early as 2012, and continuing until about July 2018, where Jason Schubert, devised seminars known as "RICH IN FIVE" hotel investment seminars. In conjuction with the seminars, the defendant identified potential investors amond attendees and solicited money from them to invest in preexisting hotel properties and he created a new hotel brand known as "EXTEND A SUITE" (EAS).

Jason Schubert also formed the Schubert Entities to conduct seminars, operate the hotels and to engage in financial transactions relating to various businesses, to manage investor funds intended for purchasing and operating hotel properties, and to use for his own personal use and benefit. The investors provided funds to the defendant based on false and fraudulent promises and representations that the funds would be used to purchase, improve, and operate hotel properties for investment.

Defendant Jason Schubert has entered a plea of "guilty" with the Court. Consequently, there will be no trial involving this defendant.

As of December 2, 2020, Jason Michael Schubert is in custody.

The sentencing hearing for the defendant, Jason Michael Schubert, has been set for february 25, 2021 at 10:00 am at the US Courthouse in Austin, Texas before Judge Robert Pitman.
