Suddenly the factoring company stopped factoring the loads done, though all appropriate information was sent to them. Suddenly the factoring company stopped communicating with me. I was sending in required paperwork and the factoring company would claim no fax received. I couldn't make the monthly quota for the factoring company because they would refuse to factor the loads. I almost lost my company as a result. I would do the work and send in paperwork to factoring company to receive payment and wouldn't get paid. Meanwhile I still had to pay all business overhead with no income coming in. I sent in a 30day notice to cancel the 6 month contract and it was confirmed received and accepted. Then they automatically renewed my contract anyway, in error. I was unable to sign with a different factoring company who would actually factor my loads. Then they said I can get out of the contract if I paid them an extra $1800, aka blackmail. I finally agreed to just pay them and be done, but they still refused to give me a letter of release, so I didn't pay the $1800. In short, I sent them a 30day cancelation letter before 6 month contract was over and I agreed to pay the bogus $1800 extra and they still refuse to allow me to move on with my business. They claim I am still locked into another 6 month contract I never agreed to. This is the worst factoring company I have ever experienced. They literally destroy companies and blackmail small businesses who don't fight back. I need to be released from this fraudulent contract ASAP. The contract has been voided by the company's refusal to adhere to services promised in the original contract for only the 6 months. They refuse to release me and give me letter required to continue work with other companies. I require this fraudulent company to adhere to the 30day cancelation notice given months ago.
JMH Transport, my company, signed on with ECS or England Carrier Services at the end of July 2016. Since then, I have had 3 different account managers, and too many accounting errors to list them all, costing my company a lot of money unjustly.
I have proof via checks written to ECS, wherein ECS has received payment for some loads from brokers, but then failed to credit my account with them and then literally they have charged back to my reserve account the full amount of my invoice plus fees.
Signed a three (3) month contract for factoring services to test the waters with them at the end of July 2016. By September 2016, I sent an official email to ECS stating that JMH Transport was NOT going to resign another contract with them beyond the three months. In this email, we requested that they send JMH the buyout amount so that JMH could go forward with obtaining a new factoring company. JMH Transport never did receive a response at all. After sitting on hold for a very long time, on multiple occasions, we never did get in touch with anyone. It is a perpetual hold when callign them to get assistance in leaving them.
In one day alone, recently, ECS took almost $11,000.00 from our reserves account, when we are only required to keep a minimum of $2500.00 in our reserve account. After contacting the reputable broker firms we transported freight for, we discovered that ECS failed to send in any of our invoices to the brokers so that they could get paid. They both failed to send invoices so brokers could pay, but then also they did receive and deposit checks that paid for our invoices and then failed to apply credit to our account, later charging back the full amount of the invoices plus additional ECS fees!
We are about to lose our business now as we are a small company, and $17,000.00 is too big of a hit for us to take. It isn't the brokers who have failed, it isn't our trucking company, it is England Carrier Services who is costing us our business and only means of providing for our family.
