The more i reviewed the facts in this transaction, the more i am convinced there is fraud at some Management) level in this company. I too received a "promotional offer" for a "free gift" of a starter ecig kit in exchange for completing a marketing survey plus the $4.95 for shipping. For me, this came when i was on the amazon website. It appears that this same scam shows up on a number of different legitimate company websites. After this initial transaction, ecigshop sent a "confirmation email" for the "order" Which went into my junk mail.) i did not find that email until after the $99.95 was charged to my account. In addition to that, i was charged $2.95 for "insurance" which i did not agree to ether.
The "confirmation email" that i first saw yesterday suggested that (1) the company has automaticaly enrolled me in an ongoing program with continuing charges, (2) i cannot cancel within the "15 day trial period" without being charged the full amount of the kit; (3) it can be returned unopened and unused for a full refund A little after the fact for those of us wh received and used the product believing it was a promotional gift.) this "confirmation email" included a link to "my easy cancel" to cancel, but that link fails, repeatedly. It is not possible to access the link to cancel. I first disputed the $99.95 with my bank and then canceled my visa card, so no further charges can be charged to that account. Today i called the company, and outlined the entire scenario along with pointing out that this has not happened to just me but also to dozens or even hundreds of customers who filed complaints.
The customer service rep first offered that i could keep the product for $50 or $59.95 I don't recall now). He then offered $30 plus the $4.95 shipping. He refunded $72.95 to my visa, which included the unauthorized insurance. He didn't have much to say and seemed alarmed about the sequence of events i described and the reports stating exactly the same fact pattern. He said he has escalated this to management. I pointed out that i still was not happy, because even the $34.95 was not what i initially agreed to, in exchange for completing the marketing survey. Supposedly, management will get back with me. We will see. I am seriously debating whether or not to call the relevant authorities to report this as fraud. The problem is that this cannot be a third party scammer because the benfit is going to ecigshop - unless it is an elaborate scheme to damage a legitimate company Unlikely). I dont know what is going on with this company, but i would avoid it altogether until there is more information about by whom this fraud was initiated Misrepresentation intended to induce and which did induce reliance). The fraud was the misrepresentation that in exchange for completing a survey, the consumer would get a "free gift" of a starter kit for only the cost of shipping. That was the agreement between the consumer and the scammer at the time the consumer agrees to and does tender payment in the form of providing a credit card number. I would never have agreed to the after-the-transaction "terms" sent by email after i provided a visa number. I am and attorney and usually pretty good at spotting scams which i routinely get by email, etc. It is no surprise that dozens or hundreds of ordinary consumers are deceived by this ploy. Yes, i am embarrassed that i got sucked into this one. Please do not use this company and never agree to a "promotional free gift" in exchange for completing a marketing survey. I learned my lesson.
