I paid no attention to that being only a point so I came back a week later. She made me believe I didn't pass so I studied hard. When I re took the test she said you did a better job but you still failed. I remembered to cut my windshield wipers on this time -- I even cut on the radio. Make a long story short, I asked to file a formal complaint which took 2 weeks to get a response. The district examiner was sent to administer the test. It took me 15 minutes to complete instead of the alloted 40 minutes. Therefore, I had enough time to re do it. Guess what I passed. I was told that I could file a formal complaint. Ms. Shepard did not do any type of investigation but concluded that her examiner did not discriminate against me. I am a certified heavy equipment operator with a degree in business management as well as a certified crane operator and prior military. To top it off I was working as a truck Driver 19th Duit for 5 months driving this same truck everday and doing the pretrip. How can I fail? That puzzled me but being the educated person that I am. I called Mary Fallon -- the governor whom got me in contact with the Attorney General who took my case free of charge.
