My response to the Better Business Bureau (Hampton Roads) as of February 15, 2018 Mr. James never gave back to me an updated contract (with the additional specifications). Mr. James would only send thru text message a partial picture because he refused to send/give me (per verbal, text, email and in person with Mr. James) an updated contract as of July 10 and 14, 2017; November 10, 2017; and December 18 & 23 2017, and between January 20 – February 9, 2017. I am demanding all monies exchanged with Dream Homes of Virginia/Mr. Julian "Brian” James due to the following: 1. Mr. James blatantly breached the contract regarding the home improvement of my roof. On July 10, 2017, my fiancé and I requested that (and Mr. James agreed to) update the agreement/specifications contract because he stated during that meeting that he was not going to utilize "A.M.P. Construction” to handle the home improvement project, as well as to provide "proof” of the updated contract form because the one he provided on July 10, 2017, had an expired license date of a "Class A Contractor Classification, CBC RBC (#2705155164) as of 12/31/2016.
On July 14, 2017, when Mr. James came back to my property to obtain my posted dated check for his service fee of $1,250.00 (out of the $2,500.00) my fiancé and I did a THOROUGH walk-thru with Mr. James (and the subcontractors, D & F All-In-1 that came out with him). On July 14, 2017, during the walk-thru of the backyard, we made very clear to Mr. James that due to pass leaks to the house, we requested (and Mr. James verbally stated) that he would make sure to have the contractors to remove all plywood and replace with new due to the age of the house and past leaks.
We asked Mr. James to add the additional specifications required for the roof (that he literally was writing down on a notepad). Reference before putting up the privacy fence, we requested very strongly (for security purpose) to remove the chain link fence to avoid trespassers using the chain link to climb over the new fence. The chain-link fence does not belong nor was put up by the City of Hampton, (see attached email confirming this matter, Jan 23, 2018); when applying the new roof, Mr. James ensured to fix the damage (from a previous hurricane) to the left side of the house; and Mr. James ensured also that the new bathroom windows would have the same frosted replacement windows because that was what the original windows were in the bathroom ( to continue to give privacy); and he offered to "throw-in” gutters (at no charge) as soon as I got approved for my loan and as long as I referred him to other customers once he got started on the home improvement projects. Last, I requested (in this order) for the electrical phase done first; the roof second; the windows third; and the private fence last. The home improvement for the roof, did not take place until December 21-27, 2017; the private fencing between January 20-30, 2018; and the replacement windows, Jan 23-February 6, 2018; and a no-show for the electrical phase between December 18, 2017 – February 7, 2018. 2. I asked Mr. James, twice, on July 14, 2017, when would I get back the actual new contract agreement (with the updated specifications) brought up-to-date because I was very concerned of the expiration date (12/31/2016) on the form (still showing as the licensed Class A Contractor Classification)?
Mr. James assured me on July 14, 2017 (after he took my $1,250.00) "…it’s a simple fix…no worries…he needed to update the form or format of the contract, and that he had all I requested written down (reference the notes he wrote down during the walk-thru on July 14, 2017) and would update the contract in its entirety. 3. When my fiancé found out that Mr. James did not have all the materials (i.e., plywood), his offer to me on December 19, 2017, was that it would cost me more money for him to replace the plywood and would be a waste of time and money. When Mr. James tried to offer the $800 for his mistake for not installing all new plywood, that’s when I started requesting between December 23, 2017 and between January 20 – February 7, 2018, a punch list of the materials, labor, etc., because I needed to know the exact cost of square footage for each plank. When he tried to offer the option to install a new patio vinyl framed glass door, my fiancé flat out told Mr. James no because my fiance could do the installation himself. Not once did Mr. James ever mentioned the cost or labor to install the glass door in exchange for his mistake for not replacing the plywood (which is why I kept asking Mr. James to submit in writing to me the actual breakdown (cost) of what my $38,980.00 went towards this uncompleted, unsatisfied worth of work done for my home improvement projects)!!!! 4. Reference the uncompleted electrical phase – I have requested from Mr. James between January 20 to February 1, 2018, that he needed to have proof that the electrician had a permit, is licensed/bonded/certified and that be here at my property during the week (not on weekends) between Monday thru Friday. He insisted only sending a certain electrician on a Sunday. This was unexpectable. On Saturday, February 3, 2018 he called and insisted that the electrician would be at the house at 9am on Sunday, February 4, 2017.
The electrician was a no-show because I missed attending 8am and 11am church services. As of February 9, 2018, Mr. James has been unprofessional, combative, argumentative…and a liar. As of February 9, 2018, Mr. James has been holding my funds "hostage” because I reported him to the Better Business Bureau. I am demanding all monies given to Mr. James due to the fact that between February 9-16, 2017, I have had to have 3 professional (licensed/bonded/certified) roofing contractors (recommended highly by Home Advisors) to come out to my property to do an "info” inspection and provide estimates of a true, factual breakdown of the specifications that should have been done to my roof. All three contractors have found not only sharp debris (see attached picture) left behind/throughout my property from the poorly installed roofing by Mr. James’ contractors. As of Sunday, February 18, 2018, there are now signs of bulging showing on my roof. Botched up "cheap materials/cheap labor” quoted by all 3 professionals is what I am now dealing with behind Dream Homes of Virginia. Mr. James had his contractors install approximately only (per the professionals) $6,000 to $10,000 worth of installation currently on my roof (if that) … not $38,980.00. I am demanding that Dream Homes of Virginia/Mr. Julian "Brian” James refund me $25,584.16 to cover the cost of not only the uncompleted electrical services, that was not performed, but also the cost of tearing off the roof, replacing the plywood, as he was supposed to do, and then replacing the roof and shingles. He also needs to confirm, in writing, that all subcontractors and suppliers have been paid in full (because during December 23, 2017 to February 3, 2018, contractors were advising me that they had not been paid); and to produce signed lien waivers from all of the subcontractors he used for this job, and include evidence of their being licensed, insured and bonded.
