In March 2016, we contacted Jamie D. Smith at DPR Realty about a property that he had listed. Smith informed us that the property was a short sale, which was not evident from the listing online. We told Smith that we were no longer interested in the property as we did not want to get into a lengthy sales process with a lot of unknowns. Smith pursued us and claimed that this particular short sale was very straight forward and he could have short sale approval in 30 days; Smith claimed he was an expert in short sales and had a team on the inside at Bank of America to push the process through.
After Smith made these claims, we expressed our concern about having to sell our current home. We did not want to move twice or have to put our belongings in storage if our house sold before we closed on the short sale. Smith claimed that if we used him as our listing agent, he would be able to control all timelines and make sure that it was a smooth transition into the short sale property. Smith also claimed that we would be able to take pre-possession of the short sale property if our home sold first; the seller of the short sale has supposedly approved this. We agreed to use Smith as our agent based on these lies.
Fast forward to May 2016; we had a buyer for our home with a scheduled close date of June 1st. Smith confirmed on multiple occasions that we would be able to move into the short sale property on June 1st. We had our entire house packed up, movers scheduled, and all utilities transferred. On May 31st, the night before we were scheduled to move, Smith told us we could not move into the short sale property unless we signed a lease and paid the seller $10k; we refused. At this point, we were closing on our home in 2 days and we had no place to move into; a family of 5 with nowhere to go. We had to negotiate with the buyer of our house to lease the house back for 18 days so we could find a place to live. JAmie Smith took his commission and disappeared.
During this process, we filed a complaint with DPR Realty and Smith's Designated Broker, Matt Deuitch. Deuitch chose to do nothing about Smith's illegal and unethical practices. Deuitch's solution was to push through and finish the deal. Deuitch treated us poorly and defended Smith's actions.
We have filed complaints with ADRE and AAR which are pending. We have retained and attorney and have to pursue a remedy leaglly since DPR and Deuitch do not believe their agent is at fault. We have lost thousands of dollars due to Smith's actions and DPR Realty does not care. Their only concern is continuing to put more agents in the marketplace so they can take 40% of commissions. Do not use this company or any of their agents; this unethical behavior starts at the top in this organization.
