DMR Construction & General Contractors LLC promised to fix a broken water pipe and restore my kitchen and bathroom after an insurance claim. Dimas Rodriguez, President of the company, required payment in full for the project and I paid him on April 13, 2021. The entire project was projected to take 2-3 weeks to complete according to DMR Construction, with the understanding that another company would be coming in to restore the rest of the unit after DMR was done.
After almost six months, the project is incomplete and the quality of the work that has been done is unprofessional, substandard and unfinished. The materials that DMR used to partially complete the project were installed wrong (baseboard running up the walls, base shoe around the shower backsplash [that was also incorrectly installed], seams with ½” gaps that were crudely filled with caulk, unfinished spackle on the freshly-painted walls [that now need to be repainted], damage to the walls, trim that was installed incorrectly to bridge two-inch gaps in the kitchen counter tops, et cetera) and the brand new bathtub was damaged during construction.
Dimas hired six subcontractors to complete the project. Of those, the first subcontractor was shot in the face during a street altercation and could not come back to work. The second subcontractor absconded with his money and quit.
The third subcontractor would bring his pit bull into the unit and stay there all day performing no work for two weeks before finally admitting that he did not know building trades and just really needed the money. The fourth subcontractor stopped working after encountering immigration problems and the fifth contractor was a plumber who installed the sinks and the toilet and proceeded to incorrectly install trim and caulk in the bathroom and kitchen.
I called Dimas and asked for a ledger prior to the final subcontractor coming to do the work. I asked for the cost of the products and labor to date and told Dimas that I was terminating the contract due to non-completion and that I wanted to negotiate a settlement for the difference of what I had paid and the work that was not done. Dimas acknowledged his dismissal and said he would provide the ledger.
Dimas arrived unannounced with the fifth contractor the day after I terminated him and begged to finish the job. He said that if the job was not finished in two days, he would refund all of the money that I paid him. I declined multiple times, but Dimas insisted, and I eventually agreed to give him “one more chance.” Dimas had previously asked for “one more chance” numerous times throughout the five-month process and I was flexible. At the time that I terminated the contract, however, I already had to notify a tenant, who wanted to move in, that the project was not going to be completed by her deadline. That cost me $1150 per month in Section 8 (guaranteed) rent. As stated above, the fifth subcontractor incorrectly installed a countertop and trim and never came back stating “Dimas isn’t paying me enough.”
I sent a demand letter to Dimas again requesting the ledger that he had ten days to deliver and failed to provide. I explained, in the letter, that if he did not provide the ledger within one week that I would take legal action and report him to all of the consumer protection agencies. Dimas said he would provide the ledger and never did. I would advise against employing DMR Construction for any services as they will accept payment and abandon their duties.
